What is the name of your state (only U.S. law)? South Carolina.

Hi, we moved in a house June 1, 2013. On June 30 I found out my parents were both in the hospital in Arizona. I called my landlord (no answer) so I text her and asked if I could pay rent late or even possibly use the deposit we gave as Julys rent and make it up at a later date. I explained to her in the text what happened. I did not get a text back. I text her again and asked the same thing. She finally responded back on July 1 and said "No, I need the rent as agreed". Our rent is due on the 1st but we have to the 5th before late charges. She said that is for of course if my check falls on the 3rd for example. So anyway, she said no, I said ok and the next day (July 2) received a certified mail 5 day notice. I thought that was a bit strange but anyway I went to her bank on the 3rd and deposited cash into her account for rent. That was it. Not a big deal. I was simply asking a favor and she couldn't do it, I was fine with it. Also, in June we had an issue with a yellow jacket nest under ground near our front door and my daughter and her friend were stung 3 and 4 times each. So that was something I called the landlord on and she had Orkin come out and take care of it. When she was here for that *around June 16th* I showed her a sort of sink hole type under the carpet in the living room. I told her it was not a big deal but just wanted her to know it was there since we had never done a walkthrough. There were also 3 outlets that were not secured to the wall, not just the plastic covers the entire box with the actually plug sockets in them. I showed her that as well. Ok, forward now to July 11th. Our Air Conditioning stops blowing. I call her, no answer, text her and she texts back "It was fine when you moved in". I text back again it is not blowing. She called the AC company and told them to come out. So two days later the AC guys arrives and says man I gotta ask you what is wrong with your landlord. She called us up yelling and screaming and told us to look for sabotage because you guys don't want to pay rent. I laughed and told him that's crazy. Well he found out what was wrong, it was a vent hose that had come off under the house that was stuck up to the vent by duct tape and it had peeled off, He secured it and put a brace around it and the air was working fine. I text the landlord told her it was fixed and thank you. Ok now July 24th the new microwave she had installed along with the fridge and stove before we moved in stopped working. I called, no answer, so I text and said the microwave is coming on but not heating. She doesn't respond back, but 2 days later I get a call from our local police dept saying she drove down to the precinct and showed them texts and I am assuming was implying I was harassing her. The officer was nice and said he understood my frustrations. I still don't get the point of her doing that. There were no threatening texts, no late night text, or anything that could be taken as so. So I just let it go and figured the microwave isn't worth the problem and I'll go down and buy a cheap one. Havent heard anything from her since and I haven't contacted her either. Well today is July 30 and I get a knock at the door and the mailman gives me a certified letter that I sign for. It reads the following word for word: Robert and Michelle This is your 5 days notice to pay the rent . As of Aug 1, 2013 to Aug 5, 2013. You have to pay your rent for Aug 2013. If the rent is not paid by Aug 5, 2013 I will talk to the sheriff and the judge to help me remove you out of my house. PS- Any damage to the house or appliances will go against you.

Ok, I have no idea what is wrong with this lady. Honestly, I don't know if we want to live here with this type of person and stress. We have 3 kids starting school in August and we like the area but honestly this lady is psychotic.

Do I have any options as a tenant? I can get a letter from the AC company saying that she told them to look for sabotage because she thinks we didn't want to pay rent if that does anything to show how she acts. If I have no options, fine, we will stay here. But it almost seems that she is the one harassing.

OK. I realize that. Since she does not communicate with us should I send her pictures of the damages and stuff that is her, the outlets, floor, etc. Buy a microwave. I love the simple answer but you do realize that there should be a level of professionalism from her meaning she needs to communicate.

You have the option to pay rent on time. It is obvious you left a very bad taste in this woman's mouth when you ask her about paying the rent late. It was quite arrogant of you to put your problems on her.

I suggest you live out the rest of your lease quietly and then move when it is up.

I concur with Zig.

When there was an issue with you paying your rent on time in June, you asked her for more time and she said NO. Your immediate response was to come up with a laundry list of items that are wrong with the place. That certainly sounds to me like you are looking for an excuse NOT to pay the rent.

Some LLs are high strung. Once they get some indication that a tenant MAY flake on paying rent on time, then that LL is super-diligent in ensuring that the tenant knows their responsibility. Anything else is just drama.

To resolve this, you're going to have to earn back her trust. To do that will require you to pay your rent ON TIME, as in on the 1st of the month, for the next several months. If you don't want to do that, you can just give her notice and move out.

Don't feed into the drama. As long as the rent is paid, you shouldn't have a problem. That's what she wants.
