Stop breaking the law and stop attempting to disenfranchise your childs right to her father. Your criminal history is looking to be a more and more convincing case for custody change. Apparently you have fallen down. Dad has refused to go with you or foot the bill.

I said I haven't found a job, I didn't say I haven't looked for a job. The only jobs available around here currently are not on a set schedule and I can only work a 1st shift position. No, I am not looking for a financial score from my Husband, I am only looking to obtain a part of what I worked for as well as him for the last 7 years.

Yes, my age and starting over does concern me....but, please tell me what else am I supposed to do? Really, I am open to suggestions.

Start looking NOW for a good family law attorney who can review the facts in your case, and promptly file for divorce. This filing should include serving your husband with a divorce petition, a standard divorce restraining order, and setting a hearing for temporary orders to establish custody, child support, spousal support if applicable, and other incidentals.

Filing for divorce first with a good attorney is FAR FAR better than allowing yourself to be unrepresented and allow your husband to "handle this" for you. In these types of cases you get what you pay for. Your attorney should be able to ensure you walk away with an equitable share of the marital assets, and whatever else you may be legally entitled to.

Your daughter has family near you -- HER FATHER. Did you clear up the warrant?

In the above thread she says her husband is abusive though in this thread he is an underinvolved but good father. In this thread he just chases skirts. No mention of abuse.

Also she states in that thread:

OG, I did take care of the speeding ticket. There was no FTA or warrant, I just had to pay the fine. DL was not suspended, so that is resolved. Yes, my daughter has her Father here, but he does not see her more than what I stated in my thread. So, if there was a situation, I would have to take her to other family. He knew of the speeding ticket situation and a possible jail term if I'd have a warrant on me, he was ok with her going to her GP's which live 1 1/2 hrs away.

I did not bring up how my Husband treated me, because that is neither here nor there with my question in this thread. I didn't report the abuse, so it is really a mute point. I finally grew a backbone and chose to leave, because I don't want our Daughter to think that is how a woman should be treated. I didn't want that to be a part of her "normal" life. Part of that is when my 14 yo witnessed him drag me across the kitchen by my hair. There have been 2 wall repairs in the family home that do not match the original wallpaper, because he put me through them. Again, non-issues since they were not reported to authorities, but my old employer is VERY aware of what went on.

I think I addressed your questions, please let me know if you want addt'l info.

I got a speeding ticket, but I will do my best not to let that happen again. I am not trying to disenfranchise our child's right to her Dad, but I'm not going to let him do that to me either. I do not have a criminal history, per se. I got a speeding ticket and that is NOT a grounds for Custody (change or otherwise) I do know that much

And also to add, when I did make Dad aware of the speeding ticket, he did offer to let me have the money to pay the fine. But, I already had the money to resolve the issue & I took care of it. He's not always a mean person, I did marry him afterall.

I was referring to your other thread, where you indicated you were skipping on the ticket for lack of money. I apologize for characterizing you incorrectly, based on the info you presented. One thing I still notice, on one hand you assert you are broke an unable to pay bills. On the other, you indicate you have sufficient bill money. It sounds like part of the problem is situating yourself in this.

Thank you for that, OH

At the time the ticket was due, No I did not have the excess funds to pay it. Also, quite frankly, I completely forgot about it until after the due date had elapsed. Not making excuses for myself, but my Dad had heart surgery and my Husband had an eye "implant" of sorts done on the same day (previous retinal detachment), in which I took him to. I was pretty scatter brained at the time and did a very poor job of keeping things together. I actually paid a lawyer $350 to walk to the clerk & pay my fine. I was prepared to face a judge & possible jail that day. But, apparently my name never made it to the actual court docket, therefore the FTA or warrant had not had time to happen yet *wiping sweat from brow* That was a bought lesson in life that I will not repeat.

I do have other income, and that is sufficient to pay my monthly bills. Doesn't leave me much, but we are managing and aren't doing without. The place I moved to, I will have paid off in 7 years and that includes an acre of land. So, I am trying to situate myself and move forward.
