Need some help with a internet subscription that I have been tricked into..

I recently purchased a lawn care tips package for $19 which I thought was going to be a one time charge. As the order page reads "one year subscription" then to the right "$19". Turns out it was $19 per month.

Emailed to cancel service after i started getting more charges next moth. Seller points me to his terms of service that state:

There are no refunds for a subscription to the Lawn Letter. Also, as stated clearly on the site, the subscription to The Lawn Letter is a one year (12 months) subscription obligation. For 12 months you are required to pay $19 per month, automatically debited from your credit card or debit card that you used to sign up for the subscription. After one year, you have the option to cancel your subscription. You can only request cancellation within the month your subscription is up for renewal. Any earlier requests for cancellation will be ignored. If you do not cancel your subscription within the one year anniversary month of your subscription, your subscription will automatically renew for another 12 months � NO EXCEPTIONS. If your credit or debit card is declined one month, or several months, you agree that Lawn Care Success, LLC has the right to attempt to charge your credit card at a later date for the previously declined charges. If you cancel your subscription before the 12 month obligation has been satisfied, by canceling your credit or debit card or your credit card or debit card can no longer be debited, you will be required to pay the balance of your subscription immediately by either certified check or money order or provide new credit or debit card information immediately.

On the home page of the site it has the 100% money back guarantee, but I guess he claims it doesn't apply to this product. (There's like three products on that page including this one.) It was a selling point to me because I figured if it wasn't what he said I could get a refund.

So I emailed him back about the guarantee and how it site makes it look like it's a one time charge. Told him if he won't honor it then I'm posting what he said on the forums, filing a bbb claim, and stopping payment on card.

He rudely responds:
"You are welcome to comment and post anything you want anywhere you want...as long as it is true. But I can promise you that if you post something untrue or damaging about my business and service, you will be sued for libel. That's a 100% guarantee. I am guessing you do not run a very good business - you don't read, you don't pay attention and you disregard details. You are welcome to contact the BBB, I will provide my rebuttal and they will disregard your claim. You can contact your credit card company as well. If you do not honor your subscription, you will be turned over to collections and your credit will be damaged."

How are his cancellation terms legal? And how is that not misrepresentation on the order page with the price and home page with the money back badging? I feel it's set up to trick people that don't read all his terms into the charges..

I think that last statement hits the nail on the head.

It doesn't trick people UNLESS they don't read all of the terms of service FIRST. Yes, it might be badly worded on the initial page, but after reading the terms of service, it clearly spells out that it is a MONTHLY charge with a no-refund policy. You, like so many others, would do well to read the TOS before committing to a purchase - especially when you realize that it doesn't meet with your expectations.

I'm sorry, but there doesn't appear to be any tricking going on here. It appears to be a smart businessperson who has covered himself quite nicely in the fine print that you chose not to read. That's not HIS fault, it's YOURS.

It states right on the front page that it is a monthly subscription and can be cancelled after the first year.

The price for The Lawn Letter subscription is only $19 a month for one year. After a year, if you are not satisfied, you can cancel your subscription and keep all of the information you have access to.

I could almost sympathize with you if the terms were in size 2 font and 40 pages long, but it's not. The business owner actually made them very readable, simple and clearly stated the guarantee doesn't include the subscription.

Concur with both responses.

It's not the seller's fault that the buyer didn't practice due diligence and actually bother to read the TOS.

A trick? Hardly. By your logic nobody should be bound by any terms they accept because it was "a trick".

The only thing that I think is potentially problematic about the whole thing is the policy that you can only cancel it specifically at the one year anniversary. That if you don't time the cancellation just right you are stuck for another year.

I am not sure that specific kind of automatic renewal is legal.

However, I also think that the publisher is blowing smoke to a great extent as well. I am sure that he manages to scare a lot of people into continuing to pay him, but I sincerely doubt that he is taking anybody to court for the $228.00 that he could have collected over the course of a year.
