Tenant Repeatedly late, what to do? can i hire a mgmt company in middle of lease?

My tenants is late again for rent this month, was due yesterday on 09/03. This is second time late in four months, the first time I waived the late fee because only late by a day and first time.

Can I transfer this property to a management company in the middle of the lease? if so what do I need to do?

They most likely won't pay the late fee even if they pay the rent this month, what do I have to do to enforce the late fee?

If you're in a state where such things are allowed and yours falls within the law, you can sue them or evict them.

One can generally assign rights to another in contract. (aka get a management company) While you could be limited in some things like where payment is to be made, depending on the wording in the lease or rental agreement, most off-the-shelf ones will handle such an eventuality.

Full rent is due = monthly rent & late fee = entire rent owed.

If they attempt to pay the monthly rent only ,then do not accept it ,or return it .Send them a pay or quit notice by the Law of your U.S. STATE. If not pd. follow through with eviction.

Sorry property is in Mesa, Arizona.

Rent is paid through direct deposit or paypal, so I can't not accept it, I suppose I could return it.

Can I have a management company take over in Arizona in the middle of a lease?

I see no reason a management Co. would be of use in payment at this time,if the current lease instructs payment by DD or paypal.

Redo your leases and include language that late rent is considered added rent , and that late rent must be included with the monthly rent, or it will be rejected.

Then at signing of new leases it would be clear.

Then send a pay or quit.

Your other option , IF your State allows ,is for the remaining of the lease accept the rent and take it out of their SD , otherwise you sue them at the end of the lease.

You have the option of not renewing.

OK update, tenant just paid, without the late fee.

I'm not going to make a big deal being one day late, but it's annoying they were late twice in 4 months.

Should I hand this over to a mgmt company now before it happens again?

They are not paying late fee, but what am I suppose to do?

If the fee is the proper amount and disclosed in the lease/rental agreement, when rent does not come in time, you issue a 5 day notice to pay the rent and late fees or they will be in breach of the lease/rental agreement. Once the rent is late, the amount owed is the rent and the late fee. (Again, if the fee is legal in disclosure and amount etc.) You don't accept partial rent after the notice is served.
