You ALWAYS do this. You pronounce something ridiculous, literally EVERYBODY tells you that you are wrong. You go out searching for citations to back you up and come up with things that doesn't even remotely apply to the situation at hand, and then you belittle those who state that you are wrong.

Roadwarrior should perhaps realize that he's trying to "best" several people who have extensive and intimate knowledge of immigration and how it relates and ties-in to family law as well as criminal law. Ironically, I'm usually the last person to join a "feel good immigration" bandwagon. Y'know, what with me having done it the absolutely legal and proper (and bloody expensive, I might add!) way.

This almost reminds me of the time when William Joseph thought that calling me an immigrant was somehow an insult.

And seriously - jump off the "LdiJ spoke so she must wrong" cart. She is NOT wrong here. You on the other hand? You're not even playing the same game, let alone being anywhere near the same ballpark.

Oh for goodness sake! Just back it up or admit your wrong and move on. It's okay to be wrong...the earth will not stop...the sun will still rise and set....:)

I was wrong in this instance. It was not because my info was wrong. It was because OP did not provide accurate information to base the conclusion on. LDiJ and Pro should also admit they state opinions without legal basis in fact. Even fertilizer grows a rose.

There goes LdiJ running her mouth without a clue what the law is. It is irrelevant whether he is daddy or not. They conspired and falsified the birth certificate. They took the birth certificate they falsified and submitted it to the Federal gov't to obtain a passport. That is all the law requires.
But, for the passport to be fraudulent the state of CA would almost certainly have to act on the FRAUD, first. Being that there is no such report apparently on file, and that INTENT is required to prove fraud (and intent to defraud is not an easy thing to prove in such a case) I don't see any action being taken.

The feds are not going to investigate a state crime. They just aren't. And until or unless the state declares the BC to be fraudulent, why would the feds stick their nose into it?

I don't see that the OP has anything to worry about at this point.
