You've paid for the privilege of having full access to and use of a vehicle that didn't ever legally belong to you. It would be the same if you had rented a car from a rental agency. You don't have the right to demand that money back. There will be no restitution made.

She wanted the car because it was HER CAR, and your failure to keep up the payments affected HER credit.
Thanks for the input and your right I paid for the use of the car and now she has possession of the car. So im entitled to my $3000 deposit made on the initial rental of the car. Thanks you just gave me the defense for unjust enrichment.

Seriously, you are a deadbeat that brought down your friend's credit rating. Leave well enough alone already

How was she unjustly enriched? You were charged for the full use and access to a car for the time you had it. YOU got what you paid for. Since you are no longer paying for it, you aren't entitled to have it anymore.

Again, I had paid the note on time for two years and had recently fallen on hard times and just because I had trouble paying the notes doesn't give her that to just take the car back. I am due some of my money back and YES she was unjustly enriched because she obtain the car under false pretenses and be lucky that's all I'm going for since the altercation involved my children being removed from the car crying by the police. And for the record I left well enough alone and let her keep the car but she sued me for the balance on the car so she opened the door for the lawsuit.

And I'll bet she's even willing to GIVE you the car after you've paid for it. :eek::eek::eek:

He may have a bit of a point about the 3000.00 down payment. The monthly payments can validly be considered as rent for the use of the car, but its not impossible that he might have a valid claim regarding the down payment.
