I decided to create a new thread on this forum because,the last thread got highjacked with pointless opinions.
My aunt has dementhia.About four months ago my sister & her boy friend decided to move in with our aunt to care for the aunt.My sister told me their plans was to move in and care for our aunt until it's time for a nurcing home.The sister stated to me she is about what is best for our aunt.At the time I thought good,great idea.
Well,I found I was wrong agreeing to the sister helping our aunt.
Three days after my sister moves in with our aunt.The sister contacts me stating she found our aunt's Will.She tells me if aunty would pass away today?Everything would go to the state.Because,everyone that was on the Will are dead.She tells me we need to get this Will changed.The first thought that ran across my mind at the time was,"why was the sister searching for the Will in the first place?".I decided to give her the benefit of the doubt and trust her.We both took our aunt up to aunt's attorney to get the Will changed.During the time with the attorney/Will,the attorney asked our aunt when she dies what do you want them/US to do with the house?The aunt replied auction the house.
After the attorney's office we parted ways and all went home.That night,I decided to do some online research just for wonders & worries I had about my sister and her boy friend.Because,before 4 months ago none of us family seen hied or hair of the sister in over 10 yrs.
What I found online is,the sister had the aunt's house for sale on a website with the sister's cell phone number attached.My wonder was why?I thought the sister's plan was to live in the aunts house to care for her until the aunt goes into the nurcing home?If that's the case,there's no reason for the house to be for sale.And the aunt's wishes in the will was to have the house auctioned after she dies.I decided to do more online research.I found News paper ads of my aunt's items for sale with the sister's cell phone number attached to the ads.To me that was more wonders and concerns.So,next I decided to call my aunt's house phone to speak with my aunt about all this stuff for sale.I got no answer at the house.The phone kept saying busy everytime I called for days.I decided to go visit my aunt.When I got to the aunt's house the sister greeted me at the door.I asked the sister what's wrong with the aunt's house phone it kepts saying busy?The sister & her boy friend tells me they had to hide the house phone because,the aunt has dementhia and keeps dialing 911.So,they had to remove the house phone from the wall.That didn't explain why the house phone line kept saying busy.If you would remove a phone from a phone jake outlet the phone line would just ring all day everytime you call not say busy.I didn't agree with them hiding the house phone.I contacted the adult social services and reported this information.
To make this story shorter,the sister & her boyfriend are now in Jail for battery to the aunt.The police found cuts & bruses on the aunt unexplained so they arrested both of them and charged them both with battery.After I learned their both in jail I decided to go see my aunt.My aunt explained to me that the sister beat her up about a month ago.I am sad for my aunt about this I had no idea what was going on .The sister is family who would of thought this would ever happen.My aunt tells me she is affraid of my sister when she gets out of jail.My aunt's affraid when the sister gets out she will come back to the aunt's house.The sister has some of her belongings in the house.The sister has a key to the house to get in.So,with my aunt agreement I changed the door locks on the house.
Next,I don't know where the sister hided the house phone .I decided to go buy a new house phone for my aunt.I plugged in the new house phone and the phone line kept ringing/saying busy with a new phone installed.I looked thru the house to find other phone jacks.And what do I find?I found a cut phone cord plugged into one of the other phone jacks in the house.At the end of the cut cord the wires was stripped and all wired together.This is why the phone line service kept saying busy.Wow,was this sister very tricky.Once I removed this cut cord the phone worked.Now everyone can call our aunt and the aunt can call out to.The bad thing about fixing the phone is,now the sister is collect calling from jail asking the aunt to bail her out.The sister has her ways of getting my aunt to bail her out I'm sure of it.And that's what I'm affraid of.I told my aunt she can file a restraining order to help keep the sister away.The aunt refuses to do this because,that's family she says you don't do that to family.I told her somethings hurt to do but,sometimes things must be done.Family or not family don't beat family and this is not right.She needs to stay in jail for what she did to you.Still the aunt refuses to file restraining order.So,the only thing I can do to help my aunt is tell her if the sister comes over don't open the door and call the police.But,knowing my aunt I feel she will let the sister in and thats the big worry.
I decided to do more online research of the sister and her boy friend.I found the boy friend has 5 other prior batterys from another state.I found that my sister has 17 different charges on her from another state and 2 are battery.I called the jail house requesting to not let the sister call my aunt's house.The jail house tells me there is nothing they can do to stop this from happening.They say to call the phone company.
So,this to me is one big mess.I don't know what to do to stop the sister from contacting the aunt.The aunt is lonely with dementia.With that said,I feel she will bail the sister out.The sister knows what to say to the aunt to get her way.One of the sisters past charges in another state is attempt bail jumping.With all the other past charges on the sister & her boy friend.I'm 99.9% sure if she is bonded out she will run.As she has attempt bail jumping before.I wonder if Indiana jail/police knows about the other state charges?I don't think so.If they did why does she have a bond?With past attempt bail jumping from another state you would think there would be a hold with no bond from past attempt bail jumping.As of now she has a bond and can be bailed out.This system is wrong I feel.Now knowing about the sister's past charges/history.No attorney should have agreed to attempt to give POA to this sister or change a Will.I contacted the attorney about all of this and adult social services.Adult social services tells me if the aunt wasn't able to be on her own?adult social services wouldn't leave her alone.I went over to my aunt's house to talk with her.She tells me she's affraid to be home alone because,if/when the sister gets out of jail.I asked my aunt what does she want.My aunt tells me she wants to live alone in her own home and try to enjoy the rest of her retirement.I said to her OK.I talked to her attorney,the attorney tells me he feels our aunt needs a POA and some type of care giver with her dementia.I agree.I don't know what else to do that I already done to help my aunt?

If your aunt contacts the phone company she can put a block on collect calls so that they cannot come through to the house at all. You should also let your aunts attorney know what is going on so that paperwork to revoke any POAs can be drawn up.

As I stated,I talked to my Aunt about all of this and she tells me her wishes is to live alone as not to have a caregiver living in with her.She tells me she has a visiting nurce come once a week to see her.I told her I feel maybe we need to have the visiting nurce come more often to see her then one day a week.
Social services tells me if they feel our aunt is not able to be on her own as alone social services wouldn't of left her alone.So,that tells me that social services feels the aunt is OK and in her correct mind to do what she wants.I asked my aunt about having the visiting nurce come over more often to see her?My aunt replies she don't want that.That is her choice nothing I can do about it.There is no POA right now.In the past i feel that the sister coached the aunt to say things and do.With that said,I don't want to look like I'm coaching as doing the same.I feel I need a witness with me with the aunt so everything is done proper.I'm not out to do anything wrong.I want to do everything correct but,this doesn't come with a manual.The aunt tells me she don't want the sister to stay with her anymore.The aunt is affraid that when the sister gets out of jail she will come back to aunt's house.The sister does have belongings of her's in the house to get out.What I'm trying to explain is this,
Sure the aunt tells me she don't want the sister there.But,once the sister gets to the aunt the aunt's story changes.Because,the sister knows what to say to the aunt to make it happen.And the aunt will most likely fall for it.That's why I feel I need a witness with me to talk to the aunt to have this confirmed she don't want the sister there.If a restraining order would be filed to the sister to stay away.By the aunt talking to the sister on the phone or letting her in the house will void the restraining order.I dealed with a restraining order on someone yrs ago and found restraining orders are pointless.In the past I had asked for a restraning order on a person.The person still came to my house arrassing me.Everytime I called the police.Nothing could be done because,the police has to catch the person in action.As long as the person is on a public side walk or street nothing can be done.The system has to many tricks for people to know & do.In order to know what to do you must become a attorney to know what to do.

You are just going to have to keep social services as involved as possible....however I do think that blocking collect calls is a must. Your sister cannot sweet talk your aunt into anything if she cannot contact her.

So in the last two days your aunt has been a doctor who diagnosed her with dementia because in your last lengthy thread on this very subject, your aunt was COMPETENT. LD, careful you don't fall into the trap of believing her.

Your aunt has dementia yet she is still driving? You can't control your aunt or dictate what she does and if she decides to bail your sister out, that's pretty much her business.

Hire a care giver???What?You must think I'm loaded with cash.I don't have the funds to pay for that out of my pocket.If the aunt don't want to pay can't force her to do so.I think it all boils down to getting the aunt into a doctor to have it confirmed if she is able to do things.If the doctor say she is ok.There's nothing I can do but,let the cards fall where they may I guess.I can only do what I can do.It's sad I must say but,it's the truth.No other family member wants to step up to this plate to give me a hand.I never done this stuff in my life.And brain smarts isn't going my direction lol.I'm a dummy when it comes to this stuff lol.The sister told me in the past she done this stuff before and knows what to do.Well,she's in Jail for battery.My guess is she didn't know what she was doing.What greed does to people is crazy.What people will do for money!I hear and seen so many people get involved in Wills out of greed.People become POA's and Gaurdenship to get acsess to elderly people's money just to take them for a ride.People move money,donate money to them self to hide money.It's not worth jail time.The Will that the sister & I went to have changed was never finalized.So,my guess is it is now void since she is now in jail for battery.As of now if the aunt dies everything will go to the state.I agree the will needs to be changed/fixed.But,I'm not Mr.Hurry to do so.Wouldn't look right on my part to act so fast.The aunt knows the will needs to be changed and so does her attorney.As of now there may be investagations going on since I called social services.I would rather wait till everything is done before thinking/acting on the Will.I personally careless about the Will.But,I rather not see the state get it all in the end and I'm sure the aunt don't want that to happen either.The sister did more then battery to my aunt I feel.I feel items and money may have been transferred by my sister's actions.But,without acsess to my aunt's accounts I have no proof.I do feel if it was looked into they will find things.But,the more I get into the more I feel this will be a big long legal mess.If the aunt don't want to be helped.I'm not out to take control.I'm sure other people would love to jump into this mess to take control out of greed.

That is false. After any legitimate creditors and probate estate administration expenses are paid, any remaining assets would be distributed according to Indiana's intestate succession statute.

Yes,I understand that.The main concern is if the aunt is able to decided from right to wrong.Without having this confirmed by a doctor nothing can be done.I never stated I want to control my aunt.I want the best for her.Since,I'm the person going to the aunt's house to check on her each day making sure she is ok and things are needed.In a way this is my business.As of now I'm the only person making sure the aunt is ok each day.So,if I'm doing all of this,it must be my business.She asked me to change the door locks because,the sister that's in jail has a key copy to the house.The aunt's affraid when the sister gets out of jail.
I think what you not understanding what I'm trying to explain is this,
Elderly people with dementia that live alone are lonely and need people to talk to.With that said,those types of people will do anything to have a friend to talk to.If it calls for moving a friend in to have someone to talk to each day that's just what they will do.Elderly people with dementia can be talked,coached to do just about anything just do have someone to talk to.That's just what the sister did.Using loneliness as a advantage to attempt to suck the aunt dry.Now the sister & the boy friend are in jail for battery.They was the care givers that went bad.Now,I'm the only one that's willing to step up to this plate to help the aunt.You say control,that's a harsh word in thought.I feel my aunt needs help.If you say control?I guess that's it.My sister walked on me and the aunt.I'm left to clean her mess.My hands are tied until the aunt can be seen by a doctor to be confirmed.The sister beatup my aunt is why they are in jail.Regardless the sister is family.The aunt will always love the sister no matter what.The aunt don't understand that the sister shouldn't of beat her.If I can't stop the sister from seeing the aunt.It's just gonna happen again.Then what? Could be worse if there's a next time.People like that don't deserve a second chance I feel.So,if the aunt decides to bond the sister out of jail.I have no other choice but to step away.I have my own Wife & kids to support & life to deal with then taking on this mess.My wife & kids come first.I can only do so much.

The attorney is full of it. Or you are not understanding what the attorney is saying. If there are legitimate creditors when your aunt passes away, those creditors get paid from any assets first. (And that is whether there is a will or not.) After the creditors are paid, any remaining assets would be distributed according to the Indiana statute to which I linked. Did you take a look at it?

You are stating that your aunt has dementia but yet she is competent but yet she hasn't been a doctor but yet.... you are full of it. NONE of what you say holds any weight. So just quit.
