Hello, My name is Ron and i am a landlord in Pennsylvania. I have a tenant who moved into a townhouse unit and gave me a check on the date we signed a lease ( Sept. 16). Unfortunately, i stupidly allowed this tenant to move in before the check cleared in my bank. The check ending up bouncing ( $1175 1st month + $1175 Security). She comes up with a excuse that she was having problems with her bank. Again i stupidly allowed her to redeposit that same check and is bounced again ( I know, I know; I should have only accepted a certified and money order). My account was charged $24. I immediately gave her a 15 day eviction notice. She is now telling me that there is mold in the basement and that there are a slew of other problems that need to be fixed. She now owes me $1175 1st month + $1175 2nd month + $24 bounced checks + Security.
The court date is set in 5 days. My question is: should i fix these problems or ignore them ( will the judge side with the tenant due to the mold or with me due to the fact that she hasn't paid anything at all; they claim the mold is only in the basement and not the rest of the townhouse). I have printed out all her emails telling me that she will pay the rent (which she never did) and i have printed my bank statement regarding the bounced checks. Should i be worried about her claims of mold? She also did not put her money in a escrow account. Thank you in advance for the replies.
