Paternity testing first?

What is the name of your state (only U.S. law)? California.

My fiancee has an ex-girlfriend who claims her youngest son is his child. No one, including my fiancee, his family and our friends believe this boy to be his. The birthdate is all wrong for that to be the case, or he would have been considered extremely premature (highly unlikely).

She's harassing him about child support. I suggested he file for custody, which should compel a paternity test if she contests our getting custody. My guess is, once she knows we are serious about getting custody she will break down and the truth will come out. What really sucks is, she named the child after him, as a "Jr".

Your boyfriend has no chance at custody at this juncture due to his current legal troubles. It doesn't matter what he says. he can request a paternity test. You know what really sucks though? You keep posting your love's legal issues all over the place as though they are YOURS. They aren't. It is none of your business what this child's name is.

Let me explain why.

This is absolutely NOTHING to do with you. And YOU are suggesting that he files for custody because he's incapable of filing to establish paternity? Really?

Frankly - and I'm a stepparent, before you start - you're going to screw up his changes if you don't learn a few things pretty damn quickly. Lose the term "we", too. You're not getting custody of anyone.

oh....my....
wasn't there a post about how your Ex spent 8 mo. in jail for his 4th DUI, and just in the last couple of days for speeding, and was either on something or had a psychotic break? (yes, yes there is: https://forum.freeadvice.com/drunk-driving-dui-dwi-27/dui-advice-601536.html#post3222488)

Not a snowball's chance in Hades does he have a chance of getting custody! Of course he should request a paternity test done (and if he isn't on the birth certificate or hasn't signed an acknowledgement of parentage, I believe most courts require it before ordering support).

But, you dear one, need to quit posting his business! Do you realize just how inappropriate that is?:confused:

After talking to an actual attorney, looks like the best route will be to let her file and that will compel paternity testing to prove that fact. But thanks for all of your input. *sarcasm*

How would your drunken boyfriend know if the child is his or not without a paternity test? After all, he could have been in the midst of a blackout at the time -- he has only been arrested for DUI how many times? OH yeah, FOUR. As for you miss buttinsky, don't let the door hit you where the good lord split you.

No one knows if the kid is his or not, not without a paternity test. Regardless, it's none of your business. YOU will not be getting custody at all.
