What is the name of your state (only U.S. law)? New Mexico.
Hi,
We recently purchased a home in June, the first year of homeowners insurance was prepaid and a check was sent to my State Farm agent from the title company for $1808. We recently changed the policy to a rental dwelling policy and the new premium is $1479. Come to find out, my agent is now telling me that she never received payment for the original policy.. so she billed my mortgage company for the new premium, my escrow account is now negative $728!! What I think has happened is, the policy and premium she sent my lender for closing.. Is not the same policy or premium she is trying to say was never paid, if that makes sense? What documents I have, that she has sent me are completely different than what she sent my lender. I am now going to be billed extra every month to get my escrow back where it should be until this gets resolved. I don't understand how this has happened. How does this happen? I'm currently waiting for my title company to produce records showing where exactly the check was sent to and if it was actually ever cashed.
What do I do if the receipts show the insurance check was cashed but my agent is still saying otherwise?? Btw, my agent flat out refuses to return my calls and only sometimes responds to my emails.. this seems fishy to me..
