Dissolution no child support till later

My lawyer is writing up the dissolution as of right now as shared evenly both residential parents. but going to see if she blows her top when I tell her tonight

You do realize that if she refuses to sign it then you are going to have to battle things out in court? Is there something that might not work for financial aid for her to go to school if she is not the residential parent? You need to find out whether her objection is something that really matters to her or could really cause her a problem or whether its just a psychological/emotional objection. If its something that she thinks is going to cause her a problem then perhaps you can find a way around that (like maybe proving it won't cause a problem, for example).

i think she wants to be custodial parent to get more gov help and she wants to go back to school. I don't think its just for child support but that couldn't help. Im trying to stop being the carrying husband and be the divorced husband. I care to much and I think she is using that to her advantage...

Well, then do some research to see if you can prove to her that she can still get government help and financial aid for school even if you have shared residential custody. However, I can tell you that if she is eligible for any state aid, then you WILL be paying child support because the state will force her to apply for it. She won't have a choice.

Other than that, you will just have to be prepared to battle it out in court if you cannot settle it between the two of you.

And the reason you can't be shared parents with a shared parenting plan? I will give you a clue -- only one person responding is an attorney in Ohio. And only that person practices family law in Ohio. Listen to LDIJ or don't... choose who want to listen to. I refuse to devote myself to someone who will question everything I state.

What did I say in the last two posts that was wrong? I am not being snarky AT ALL. If there was something wrong I would like to know what it was. I was attempting to encourage him to find a way to demonstrate to mom that shared residential custody would not cause her any problems so that she would be willing to sign the agreement.

Come on OG...isn't the first way to overcome an objection to something is figuring out WHY the person has that objection?

Was it untrue that if she qualifies for state aid that he will be paying child support even with shared parenting? What did I say that was incorrect?

She will get help shared split parenting or not and they will come for child support. And in the overall picture my son will be benefitting.

You have an attorney. Apparently your attorney doesn't understand the law in Ohio. She can be residential parent for state aid purposes while both of you are considered residential parent of the children. One designation does not cancel the other. Why hasn't your attorney explained this to you? Split parenting is different than shared parenting. There are nuances in the shared parenting provisions that your attorney should know if he is going to be representing you in a shared parenting argument.

And my sincere apologies to LD for jumping on her. I was in the wrong and should not have.

I only told my attorney that I want us both residential parents but my soon to be wife said if she doesn't get residential parent it will turn into a nasty divorce. While I could do that and sell some belongings and have a big fight is it going to be worth it over a title of residential parent? So then I'm out another 4 5 grand and what will I gain?

YOu need to talk to your attorney quite frankly. Are you going to have shared parenting? Or is she going to have full custody? There are some many nuances that matter to the designation.
