I'm sure the motion had some case law history researched by the attorney and viewed as possibly successful relative to similiar cases. You don't go into court convicted of first degree murder and on death row asking for expungement of the record. Would a judge even have to hear that motion?

We're not getting the whole story here other than a judge played psychiatrist and denied the motion.
Well....it could be because the judge was the same one who heard the Ex plead "guilty" in the first place.
Same judge that had 3 different officers who had witnessed the "aftermath" of Ex's temper tantrum and wrote reports.
Could be because the Ex told the judge he didn't know what it had meant to plea guilty....(yes, the Ex actually said that).
Could be because it was a neighbor who called the police after hearing my Ex scream at me "I'm going to F**CKIN' Kill you"
Could be because Ex still didn't take responsibility for his own actions ( his statements to the judge "She shouldn't have slammed the door," (yep, that's what started it all--I slammed a door) , "the only reason I was arrested was because *she* knew the cops and were friends with them" "I really didn't do anything, just kind of pushed her" (yeah, with his forearm up against a wall and continued to "just kind of push me" into the wall pinning me against the wall w/ his forearm bruising me from shoulder to shoulder).
Could be because before the judge was a judge, he was a Highway Patrolman with a degree in Criminal Justice, who had seen far too many domestic assaults.

I don't know.

Fear is a terrible paralyzer, or it can be a huge motivator. To poo-poo someone who is genuinely afraid of their spouse is tantamount to calling that person a liar.

Sounds like the judge should have recused himself from the expungement hearing. He clearly has a bias against this citizen.
