I was involved in a car accident. The police report has no citations only contributing factors to the accident. Me: inattentive driving, pulling out of a private drive, Him: inattentive driving, unsafe speed, illegal lane change. I pulled out into a clear, far right lane of an access road, turning right. He was passing a car on the access road, merged into my lane and hit me from behind. His insurance accepts no liability and he has retained a lawyer now. My company offered 30 me 70 him. Both cars are totaled and he has had a foot injury/surgery from stomping on the break too hard. In the police report he admits to going too fast. An eye witness also described in the report that he was speeding and hit me after merging into my lane after I had control of the lane. He does not accept my insurance's offer and has retained an attorney. His insurance rejects any liability. The car he was driving was not in his name. I am assuming a relative with the same last name. However, I'm not sure that makes any difference in why insurance won't pay. I talked to an attorney and he said he couldn't help me, because I didn't have any medical issues. I told him I wasn't seeking retribution just assistance in what I need to do. He said don't worry, the insurance will work it out. I left kind of feeling unsettled. Is this true? Should I be more concerned? Should I get a second opinion?
