nieces in foster care

I currently live in Tennessee and my whole family is in new York. I recently discovered that my father has custody of my nephew while they put my nieces in foster care. I have tried to go for custody but got denied because i live in Tennessee. My fiancee and I have three kids of our own and we both are working...and have really good jobs. Although we do live in Tennessee why wouldn't I be a more suitable custodial guardian of my nieces instead of the state. They never gave anyone in my family a chance. It is believed my nieces are being hurt in state care...what can I do??? I want my nieces home with me and their cousins...this isn't right...please help

Move to NY. :cool:

States loathe to send children out of their control once the state has to assume custody. Follow-up is difficult. NYS doesn't have control over what goes on in TN.

So, you're an unmarried couple, working full time with 3 other children. Tell me, how can you properly supervise two additional children in a foster-care situation?

How long have the children been in foster care? An ICPC (interstate compact) would be required to be approved and that process can take more than six months. Hence, that is why you are not a more suitable guardian at this point. You would need to complete a home study, show you have a relationship with the children, be willing to travel to New York for at least one -- if not more -- hearings. You would need to show that you have a stable residence and appropriate ability to support additional children. You are your fiancée are NOT married at this juncture and that could pose a bit of a problem because engaged is not as stable as being married. You also need to have a suitably sized place -- two bedrooms is not going to cut it. You may need a three to four bedroom residence. Also, if you are both working how would you provide child care (how could you afford it)? What special needs do your nieces have? What issues are present in their lives? Is reunification with your sister or the children's father(s) still on the table? If so, then the child are NOT going to be sent away from the parents to another state where reunification is more difficult.

I don't think OP did, I believe that OG was just using a random number for example purposes (I could be wrong, and OG will correct me if I'm wrong;))

As an aside:
I confused this poster with ambielee91 who posted about NY as well today but was the victim of DV.
