I wrote a check for $50.65 for my gas company, but the bank posted it as $506.53. What legal advice can you offer me?
There are not overdraft just yet but I need the money in my account soon to clear other checks that I have send out.

What is the name of your state (only U.S. law)? Massachusetts

Did you call the bank? did you check online to see a copy of the check? Did you apprise the bank of their error?

Contact your bank right now. Point out their error.

:confused: Am I missing something? Why ask us instead of your bank?

I spoke to my bank and they will get in contact with the company. They said it was the company's mistake.
Now I have to wait until Tuesday for any news.

That doesn't make sense yet.

Your gas company should be open for business today. And the bank should have your check.

A lot of it is done electronically these days. The bank gets a digital version of the check instead of the actual check. So if the company made the mistake, the bank wouldn't be able to see that.

And you think there's some kind of legal action you can take today that will somehow resolve this before Tuesday? :confused:

And the gas company is not open for questions today from the bank or the customer?

If it was sent and cleared as a paper check there is a facsimile made of the check and that is used in place of the paper check. The bank has an actual image to look at. If it was an EFT, then there is no "picture" to look at.


If it was accepted as a paper check, then it is the payor's banks error and the bank can review the check and take action now.


if it was an EFT, then depending on a couple different things it could be different but it is more than likely the payees fault as they key in the amount tendered. Not sure if the bank can put a hold on the disputed funds but I would think they could and if they could they could do it immediately.
