Hi Everyone,

New to the forums. And new to legal problems. If a criminal case is dismissed/dropped by the prosecuting attorney before the first hearing with a Magistrate, does that mean my mugshot and fingerprint records all get shredded/thrown out? Will it ever appear on my record during a background check as an arrest/charge? Also, if I have and Ordinance complaint-Affidavit-Summons type ticket, does that mean I have been formally charged yet?

No to the mugshot and fingerprints being shredded/thrown out. Regardless of the outcome of the "case", the mugshot and fingerprints will live on, simply because there was a case.

And unless things have changed: It will depend on what kind of and how in depth a background check is done, whether it will show up.

Thank you so much for your response. Does this still stand true even if the prosecutor voids the ticket because of a wrongful arrest type situation. Being as generic as possible (because of the internet) lets say I was arrested for a crime. But the witness came forward and told the prosecutor more details that made the arrest wrongful and that's why the ticket/charges were voided. Do you have any information on that?

The finger prints and mugshot are NOT shredded for any legitimate reason. They live on. What is the big deal? Lots of people have their picture and finger prints on record and not for any criminal reason. In my state for instance, EVERY ATTORNEY (or person who wants to take the Bar exam) must be fingerprinted and such information is on record with the state.
