A homeowners association has recently decided to disallow a relative from running a day care in her house based on the premise of aesthetic integrity of the community is maintained. The day care has been running for 7 years already and is the family's sole source of income. PMG Houston Houston, Texas
What options do they have?
Can they force them to stop if they knowingly allowed the business to operate?
If they are able to prove the business does not affect the aesthetic integrity, will it help them fight the cease and desist order? (i.e. toys in the yard, general appearance of the house relative to others, effects on the neighborhood, opinions of neighbors)
