Alabama Vs. Virginia Divorce

I have been in the processing of divorcing my husband for 4 years in Virginia. He keeps contesting the divorce which keeps dragging out the process. Virginia does not allow you to be legal separated but we have not lived in the same home since May 2011. We do not have children together, do not own any property together - nothing is tying us together but his continuous effort to delay the inevitable.

My question: I am a Alabama resident by birth and plan on moving back in the next few year (I already have family in the area), would it be possible to discontinue my divorce battle in Virginia and start over in Alabama? If so, will it be a quicker process?

No, it doesn't work that way. You will need to wrap this up in VA.

What specifically is delaying the process? He contests, you go to court. If he contests in Virginia, why would he not contest in Alabama?

If he is set on delaying the process, it will be no quicker in Alabama. His contesting the divorce should not prevent the divorce, only delay it. And if Alabama is a few years off? You could be finished with the process by the time you move.
