After a year struggling to purchase our wedding photos from our photographer, he now refuses to sell us prints unless we sign an inaccurate contract that is back dated.
Any experience with this type of situation. No written contract was made but we do have many e-mails and text messages as to what was sappose to transpire.
Is this a small claims issue? What can I do to urge him to sell me the prints and avoid legal action?

That's why you get contracts upfront . You want them pay the price . You don't even have the pics to compare reasonable cost with others. Up to you ,find a way if you want them.

Is this "contract" signed by you or your husband?

I think the question isn't which party signed it, but rather whether or not one of them signed it.
I would agree with that. If there was no contract all because neither one of them signed one, then it gets really murky.

Why is the photographer refusing to sell you prints of the photographs? Other than selling wedding photos to wedding couples, a photographer has little use for the photos.

It is impossible to tell from what you have written if you have any legal action to pursue. It is also impossible to say what you can do to urge the photographer to sell you the photos - other than meeting his apparent demands of signing an "inaccurate" backdated contract, that is.

Could you please provide more information?
