Email NDA - Type to Sign

What is the name of your state (only U.S. law)?

I'm discussing a project with someone online and on the telephone. If I send an NDA by email, can they type to sign and have that be binding? If it is possible to do this by email, is it better to put the text into the body of the email, rather than sending it as an attachment?

Why not mail the form and have them sign it that way? Or, email the form, have them sign it, scan the signed form and email it back to you?

I would advise that you ask for the original form to be mailed back to you. Heck, you might even want to have it notarized.

If you can afford it, look into services like Docusign. Very simple, very auditable, and easy for everybody to use - no scanning required.
