What is the name of your state (only U.S. law)? CA

Hello,

I am in a situation where we have an Impound Escrow account, our servicer is Green Tree. Last month we received a notice that our property taxes are in default. We have been contacting Green Tree to get this resolved but we keep getting the run around. A quick google for Green Tree brings up all sorts of horror stories.

What are my legal options in this situation?

Pay the taxes and wait for an eventual refund from Green Tree of excess escrow.

Thanks. We are willing to do this but it appears that Green Tree has a habit of doing this to it clients. Not sure I would even get the excess back. Was trying to see what other options I have.

The laws are pretty strict about how much money a mortgage company is allowed to hold in escrow. It could get them into major trouble if they sit on a large excess.

The last time a lender did this to me, I worked my way up the food chain until I got them to waive the escrow impound. Servicers are in general incompetent.
Makes me glad I no longer have any mortgages.

I have never had a problem with mine...but its nearly done.
