single dad: anything in particular I should look for in an attorney? I have reached out to several that handle consumer credit, a few last week, and a handful after posting here. I haven't heard back from anyone yet.

What are some indicators they would be a fit for handling this case? Are there specific points/facts I should be leading with in conversation to attract a good one? Are there specific questions I should ask them in reference to their experience or intentions? Are there any resources to vet such a thing or possibly websites that allow people to talk about their experiences with them?

Although it appears you have a bit of a case, many Attorneys may not be interested in it. It seems this is the situation here as none of the several Attorneys you contacted have responded.

Your only recourse is to find a good Attorney and pay him for his services or research in a Law Library to gain the knowledge in order to draft, file and maintain a lawsuit for your particular case or let it go. Good luck to you.

Thanks Nelli, why do you think many Attorneys may not be interested? I don't want to waste anyone's time, especially the limited amount I have. I wouldn't expect many (if any) to respond over Laborday Weekend, certainly wouldn't hold it against them. With that said I have received a few messages back today, one of which is a Consumer Credit attorney that seems to have a significant amount of experience and success in similar matters. The message I've sent them is almost verbatim to my first post on this thread so I have to assume they understand the circumstance.

I am sure any attorney experienced in consumer protection law will understand your circumstance and, as single317dad said, will be interested in what you have to say. It appears, as I said earlier, that you have a case that is worth pursuing.

When you intend to challenge in court a company like Encore Capital Group, you need to know that you will be facing an experienced and rather nasty opponent, even though they may be a bit humbled after their several losses in courts across the country. You need an attorney who is willing to stand up to them. An attorney who is experienced in handling debt collection agencies is a must for any attorney you hire. latigo mentioned "aggressive" and "successful" as desirable traits as well, and I agree.

Don't be afraid to ask an attorney for his professional credentials, his experience in court with similar cases, and, of course, his rates. Do not be lured into hiring a lawyer just because the fees he is charging are less than any of the others you contact. But don't be conned into thinking that the highest price lawyers are the best. Again, more important than cost is how likely he is to win for you all that you desire.

It can also be important to sit down with the attorney and get a feel for his personality. You want an attorney who will fight FOR you but you do not want one that will fight WITH you.

And do not sign ANY contract until you fully understand all of the terms of the contract. Have the attorney explain to you anything you are unclear on. A good attorney has no problem going over everything with you so that you know exactly what you are getting for your money.

Based solely on what you have posted here about your problems with Midland, there are definite indications that Midland has violated one or more laws and can be held accountable for these violations.

One additional note that I tried to edit into my earlier post but I am apparently having issues with the "edit" feature tonight:

Do not put much weight into not hearing back from attorneys right away. This probably does not mean that they do not have an interest in your case but rather, as you suspect, that they are simply enjoying a holiday weekend. Although attorneys are often known for working many hours every day and often every day of every week, even they like to spend time with family now and then. :)

I guess the true party/s at fault here is XXXXXX, LLP; and XXXXXXXX, ESQ, and this isn't unusual behavior/practices from them.

Thanks to all the advice from everyone on this forum I was able to find a great attorney, we have drafted and will be filing a complaint containing 6 claims.

We're optimistic this is a good case and I'm looking forward to holding party/s accountable for their actions. This kind of stuff shouldn't happen to people. I know there are lots of irresponsible people out there that should be held accountable for their debts and such, but I believe it's even more irresponsible for a firm to defame and cause hardship to people innocent of such irresponsibility.

I'll keep this thread updated.
