What is the name of your state (only U.S. law)? Massachuetts
My question involves a power of attorney in the state of: Massachusetts.
I have an urgent question, regarding my parents perhaps having taken power of attorney away from me by fraudulently misrepresenting documents and telling me they were something else, instead of power of attorney documents.
I am a 26 year old full-time college student at UMass Lowell, double majoring in History and Psychology and currently considering declaring Pre-Law, working 20-30 hours to pay the bills in my studio apartment. I am living all on my own, paying all the bills, getting my just fine, going to school and working and such. My parents are getting older and are sort of starting to lose it, my dad's mom had Alzheimer's and I believe that he might have it also. Despite the fact that I am a completely autonomous adult, they are sort of starting to get a bit senile and are starting to lose it, and I believe that they might have fraudulently misrepresented documents to me, to have me sign, to attempt to take power of attorney and/or legal guardianship of me.
I need to find out immediately, how I can obtain record of this having been done or not? Should I contact my local District Court? To speak to Clerk to find out if I can find record of papers having been recorded?
I tried contacting the Attorney General's Office, since this is essentially the same situation as elder abuse or taking power of attorney from an elderly person, just in reverse, however they were of no help and said that I should contact the Massachusetts BAR association instead to contact legal counsel.
I just need to find out what the first step is that I should take in trying to get official proof of how this may have happened, and if these papers were indeed what I think they might've been. I have considered this point since, given that I realized that of course a person does not necessarily have to sign any legal documents to contract with a lawyer to have them represent them, and also in light of subsequent events since those papers were signed.
I know that I was asked to sign some documents a while back, which my parents quickly approached me with as I was coming back home from a night out drinking with friends. They gave me these documents, which they told me were in regards to signing to contract to have a lawyer represent me in a civil matter, a car accident. An attorney that my dad knew well, one of his friends, who was going to do it as sort of a favor.
The fact that these documents were given to me to sign under false pretenses, I am fairly certain makes them void in a court of law, and all subsequent actions taken based upon them illegal.
The fact that these documents were intentionally given to me to sign while I was intoxicated, after coming home from a night out drinking with friends, I am fairly certain makes them void in a court of law, and all subsequent actions taken based upon them illegal.
I never appeared before a judge to be deemed incompetent, and to have power of attorney stripped from me. I recently asked my parents about these documents, demanding copies of them, and my dad said "I don't remember, I don't remember, I can't talk about this with you" and hung up the phone instantly. The next day I contacted him by phone demanding copies of those documents, and that if he indeed did not remember those documents, demanding that he send me a signed and dated letter, stating that he does not recall whether he did give me sign any legal documents to sign between these specific dates. He was unsure of what to say and said the he didn't want to sign any legal paperwork and that he didn't know if he could write that letter.
I have also since sent him a formal letter, demanding copies of those documents and/or the aforementioned letter to me in response, stating his inability to recall any legal paperwork given to me to sign.
Please assist me in this matter immediately, anyone who has any knowledge in this area. I am fairly well versed in legal matters and able to handle myself, however I just do not know where to start in this matter, who I should contact or how I should go about finding out the first piece of information, proving that these documents may indeed have been power of attorney documents?
I will contact my District Court clerk immediately if that is the best avenue to go, to find any legal paperwork that may have been processed with my name on it, however I am just not certain as to where I should start. I do not have the money to hire an attorney, so like always I will just be doing this on my own, which is just fine.
