What is the name of your state (only U.S. law)? Texas
We filed common law marriage with the county clerk about 2 months ago.
I have been living with a man for over a year. He initially insisted that we have a joint account in which I send all my direct deposits from work etc.
Immediately, I noticed he took all of my money and put it in his own account. I have no checks or debit cards for this account he transfers to -- it is ONLY HIS account.
All he gives me is a credit card to use for spending — but none of my money. I have bad credit from a previous divorce, so I have no other credit cards.
I have asked for separate accounts and he refuses. So, in total he has about 45 thousand dollars of my money. He says he’s using it for bills — but my bills are about 1k a month only. (That includes my car payment and insurance)…and incidentals.
Also — he had me turn in my lease and he bought a fancy car for me to drive — in HIS name. He uses my money to pay a car payment of 1100 a month. My previous car payment was 400.
Last month he told me he wanted me on his health insurance, because it’s cheaper than mine. He and I went to court and filed common law marriage. We got an actual certificate
My problem now is that he watches me on cameras in the house. He’s very suspicious that I’m hiding money from him. He was angry that I made a cash deposit into the joint account instead of paying with a hard check that he could see.
He tells me now that he feels as if he is going to have a heart attack — because of this gut feeling that I’m hiding something from him. I am actually hiding some money from him — but I don’t have much.
I am trying to get out of this situation — I found a new lease and I am ready to go, but I have none of my money.
By my estimate, he owes me about 45k — Can I get him to sign a blank check (for house cleaners) and fill in my name -- and cash it?
But, I’m wondering what to do here. Do I have any recourse?
I should also say I lost my previous job because of him. He pressured me so much and distracted me on the job so much…I had to notify the authorities. My employer even had a security notice when he showed up.
I ended up moving with him in the first place — because I had no other source of income or housing. I figured that I would save up enough money to eventually leave, but he never let that happen.
He has also been arrested for preventing me from dialing 911. He got a fancy $$$ attorney and got off on a technicality.
I guess I’m wondering If I have a case here. What do I do?
He makes me share my location on my phone so I can’t go into a law office to have a consultation. he would know. He tracks my every move. He even told me this morning that he went back to check out my stories about getting the mail at the mailbox — (where my paycheck was)… by watching his security footage while I slept.
