Can Creditors Take Donations Given To Me

Well, I have a long and complicated story, but I will try to make it as brief and to the point as I possibly can.

About three years ago I was diagnosed with a brain injury, and put on permanent disability. At the time that I received my diagnosis, we also lost our home, along with all of our possessions, and by this time I had accumulated approx $20,000 in debt, due to being out of work for two years.

Before I left my home the creditors were threatening to sue, but I told that I had nothing (the truth) and that I would consider any future contact to he harassment.

We really didn't have any place to go in California, and none of the social agencies really seemed interested in helping me. My wife's family owns land overseas, so we fled over there to have a roof over our heads. The problem is that I'm not getting very much in disability, and it is not at all cheap to live over here. Also, the conditions are somewhat primitive, and I'm often sick. Unfortunately I cannot afford a plane ticket home, and even if I could, there is no place to go.

Someone told me that I should post something on Go Fund Me, but I'm not sure if that is such a good idea due to the fact that I'm not certain if money I receive from online donors would be considered a taxable income or not? If I received enough money to buy a plane ticket, could my creditors from three - four years ago demand part of the money? Would the IRS consider the donations as taxable income?

Any info greatly appreciated.

GoFundMe receipts may or may not be taxable. In your case, I would suspect they would just be considered untaxable gifts.

However, the gifts you receive aren't in any way protectable. They're an asset and if your creditors have a judgement against you, they can certainly be attached..

Why didn't you declare bankruptcy instead of running from your debt?

An attorney advised me that I didn't need to file for bankruptcy, due to the fact that my only source of income was disability and I did not own any assets. I didn't necessarily leave because I was running from debt. I left because we no longer had a place to live.

What kind of disability are you on? e.g. is this disability through your former job, SSD, SSI, or something else?
