We got 1 month behind on our vehicle load at a buy here pay here company. Yes, we are in the wrong, I know.
I have never been contacted in any for from te Company but my husband has. They have called him many times and it is the same person each time. This man is VERY ****y and nasty. He will instigate and antagonize and I mean really is very nasty. So my husband quit answering the calls.
So today this same man came to my home and introduced himself. He informed me that he worked for the automotive group that we purchased our car from. He then proceeded to tell me he was repo'ing our car and if there was anything that I wanted out of it before he took it. So I said yes and walked outside to empty the car out.
He asked why we were late on the payment and I proceeded to tell him why we had gotten behind. He then asked me why my husband wouldnt take his calls and I told him I honestly didn't know that he had been ignoring his calls.
I asked the gentleman if I could make a payment right then to keep him from taking the car and he said no.
So I kept. Cleaning it out. He then started to get nasty and started lecturing me on being responsible and making my payments . I asked him how much I owed to make the car loan current and he wouldn't tell me he just kept asking why my husband was being irresponsible and not answering his calls. I asked him again if I could pay him or make payment to remedy the situation and again he said no. So I stopped talking and proceeded to clean out my car. He just kept on instigating and when I wouldn't answer he said "oh you're not talking now"!
I told him no I wasn't as he was wanting to start drama which I wanted nothing to do with. He told me to leave the keys in the car so I did and I asked one more time what can we do to make the payment current and he wouldn't answer. He just kept saying that we weren't serious or responsible and that he has to come out of state to track us down since we wouldn't answer his calls. I have home permission to check my cell phone to verify that he has NEVER tried to contact me about the late payment but her is standing in my driveway yelling at me about hiding from him.
I proceeded to walk into my home as I was done with this drama .
But I had forgotten my phone and garage door opener outside so I went back out to retrieve them before he took my car. At that time he was on the phone to my husband and pretty much saying the same things that he had said to me.
My husband soon called me as I walked back into my home. I went back outside one more time with my husband in the phone and asked the man once again if he would or could take a payment right then and there to make our account current and he again said he felt that we weren't serious and would not keep paying the car loan. He then in front of my children at this time kept telling me how irresponsible I was and that he was done trying to negotiate with us and he pulled out a steering column club. I just walked into the house and he locked my steering wheel and took my keys and left. Now my husband and I asked several times for the past due amount and asked several times if he would take payment and he refused to give us any information.
I have never seen such unprofessionalism in all of my 42years!
I was so shaken that it was hours later that I realized that he was pretty much harassing me and he even said he couldn't take my car as he was by himself. But every time I asked him to give me a past due balance or take my payment her would say no or that we were not serious enough .
I will admit that I felt that clubbing my car with no intention to repo it at that time was uncalled for and possibly illegal so I removed the club! And yes we tried calling the dealership after he Kerry to make a payment but at that time is was past 5pm and the secretary had left for the day.
My husband did talk to a sales and and mentioned how this man had acted and the salesman knew exactly who we were talking about but said his hands were tied and wouldn't say anything else.
So is this something that I should contact my attorney about? I feel it's very unethical and illegal as to how he acted.
