What is the name of your state (only U.S. law)? Ohio
If you are getting a divorce you can't. More details please. If this is a CSB case in Ohio and they have moved for permanent custody.. you might want to seriously consider it if you ever want to have other children.

There are two ways a parent can accomplish that. Fall over dead or consent to an adoption.

Which seems preferable?
Without more info we rally don't know if either of those "options" is viable.
