I have a non compete with the company I worked for. I had a brain injury in January working for them. I was out on workers comp for 6 months. Workers comp wouldn't even pay me for six months and still refuses to pay my medical expenses.

I got released to go back to work and immediately upon arriving back my manager told me that he was instructed to make my job and life as uncomfortable as possible because "the higher ups" want to make me to quit.

That was right after they put me at a desk in the direct sunlight through a garage door in 90 degree weather on July 5th. Even though there were several empty offices with air conditioning.

I felt so completely uncomfortable. I literally felt like a victim. I quit and walked out. They had already taken my company vehicle from me, they took my company cell phone, and they took away my earning potential. I was only going to make 30k with them with no benefits. Before, I made 30k with commission that equalled almost $10,000, had a company car with the privilege to use it however I wanted, and a company cell phone which they took away from me when I got hurt in a car wreck where I was rear ended by another one of their employees on the way to a job site.

I'm still receiving treatment for the health ailments that I suffer with daily from the accident. Mostly just migraines, blurred vision, extreme anxiety, and disorientation.

I started my own company doing something similar because I had no choice after I was pushed out. It's the only thing I know how to do well and I have to provide for my four year old son. I've got bills man. Now they are threatening to sue me for violating a non compete agreement ever after they did all of that to me.

I am so stressed about this.

I am worried that they can make me/my company that I own cease operations until a trial or arbitration. I just can't afford to stop doing business, I will lose everything I have, including my son, and my business.

What do I do? I need to protect myself from these corporate bullies.

You should hire an attorney to look over the non-compete agreement you signed.

I don't have a copy of the non compete contract. They never gave me a copy of it.
Well, that is a problem.

You will want to get a copy of your contract with your former employer. If necessary, you can have an attorney do this for you.

Although Tennessee disfavors non-compete agreements as a restraint on trade (as do most states), well-drafted agreements will be upheld in court in whole or in part (as they will be in most states).

You need to discover the terms of your agreement to see if the agreement as written is unenforceable. Enforceability will center on the contract's protection of legitimate business interests, and the length of time the agreement not to compete is said to be in effect, and the geographic scope.

Once you go over with your attorney the terms of the non-compete agreement, you will know better if your former employer's threats to sue have merit.
