I had typed an entire story and it went away when I tried to post. What is the name of your state (only U.S. law)? Florida
Why haven't you submitted a parenting plan? You need to do so ASAP. Your desire to have visits phased in needs to be part of your parenting plan. Yes, its likely that a magistrate would allow a phased in plan if you give the magistrate another parenting plan to choose from.I had typed an entire story and it went away when I tried to post.
I have a 7/8 month old. Her father filed for paternity to establish his rights and he submitted his parenting plan. So far I have answered, taken the mandatory parenting class, filed and mailed to him my financial affidavit and mandatory disclosure. We have a15 min hearing next month before a GM.
1) what usually happens at the hearing with the general Magistrate?
2) the father has seen our child Maybe 4 hours out of the past five to six months, yet he is asking for 60/40, does the judge care about his current efforts or lack thereof?
Side note: I have offered several times to meet him in a public place so he can spend time with her in a public setting until she is more familiar with him however he only wants unsupervised time with her at his home. The public setting was his initial idea now he refuses to do that.
3)If I request initial supervised visits is the court likely to honor that request short term until he is more comfortable with her as he has never been alone with her?
4) is there a standard reunification process?
I consulted with an attorney and he told me that all I needed to do now was answer and when we meet for mediation then I could present my plan. I have been working on it. It's something I'm putting extensive energy and thought into so it's as thorough and seamless as possible. What is the hearing? Is something finalized at the hearing? Why haven't you submitted a parenting plan? You need to do so ASAP. Your desire to have visits phased in needs to be part of your parenting plan. That hearing is probably when you will get ordered to mediation if its only scheduled for 15 minutes. Temporary orders could possibly get made there as well. Also the dad wants to changes out our daughters last name. I'm not agreement. Is it likely the judge will order that? Our hearing is only 15 mins. What can happen in that limited time frame?
Ok, thank you! That hearing is probably when you will get ordered to mediation if its only scheduled for 15 minutes. Temporary orders could possibly get made there as well.
