What is the name of your state (only U.S. law)? New Jersey
Please I know how wrong it is but I am not a bad person. I'm 46 and have never been in trouble in my life until 2 months ago I got a dui. Went to court. Paying my fines. I'm a single mom and got caught driving to work. I'm already going to see a lawyer but does anyone... please... can you share your personal stories. If I go to jail I'm going to lose my job and kids.

You better get that lawyer. You are facing:

$500 fine
An extension of your suspension by a YEAR.
A minimum of ten, and as many as 90 days in jail.

By the way STOP BREAKING THE LAW. They catch you driving AGAIN while suspended, you WILL spend 180 days in jail. Further, that is a "fourth degree crime" in NJ or what other states call a felony. Very serious implications that will stick with you for the rest of your life.

please... can you share your personal stories.

There are no other criminals around here right now to share stories with you.

You are going to see an attorney - that is the only person you need to talk to about your case.

"Record for dismissals"? What would be a reason for the case against the OP to be dismissed?
Simple, these charges in NJ require an effective defense. This isn't an "Oh well better luck next time" type of deal.
If she wants to get her license back, keep her job, house, and child, this is the time to higher an experienced fighter.

Here is a link to the laws in New Jersey on license suspensions as a result of a DUI conviction, which FlyingRon outlined for you in his post above: http://www.nj.gov/mvc/Violations/dui.htm

A driver's license suspension that comes as a result of a DUI cannot be "dismissed," as was implied earlier by another poster. The license suspension is a state-mandated suspension.

The reason you will want an attorney is so you will have the best chance of staying out of jail. Your attorney will be working with you toward that goal. In the meantime, you might want to line up someone to watch your children, in case you find yourself having to spend some time in jail. You might also look into alternate ways to get to and from work, assuming you will still have your job after this latest arrest.

Good luck.

The DA has to prove all the elements of that infraction. Even if they prove you were driving while suspended. That's why so many in NJ get pled down. I've seen a lot of cases that got tossed because the lawyer knew how to handle small errors...
The OP is fighting for her life. She needs an expert that can go through everything and produce a victory for her if possible. I'm not here to arguing if she is guilty or not. She came here for good advice because she's in trouble.

It is not wrong. Her license was suspended as a result of a DUI conviction. That suspension is NOT going away.

Because DumbMe KNEW she was driving on a suspended license because it resulted from her DUI conviction, the most the attorney she sees now can do is help from getting the suspension extended and help her from going to jail for driving on the suspended license.

These are mandatory suspensions we are talking about here, Insane Jane.

And, because I have not seen any indication in any of your posts that you have even seen ONE case or know anything at all about the law, I doubt very strongly your claim that you have "seen a lot of cases that got tossed because the lawyer knew how to handle small errors ..."

You are right about one thing only. DumbMe came to this forum looking for GOOD advice. I recommend you do not post again until you can provide some. Thanks.

My apologies. I misread you post and thought you stated "Driving on suspension that comes as a result of a DUI cannot be "dismissed,"

I suggest that you read more carefully from now on, then, because judging from your brief posting history you seem to have a habit of misreading posts.

Additionally, I recommend you are very careful about calling other forum members "wrong" unless you know what you are talking about. I see that you edited your previous post, and I appreciate that.

One final note: All the State has to do to support a "driving while suspended" charge is show the court that the poster was driving and show a certified abstract from the Department of Motor Vehicles which shows the license was suspended. That's it.
