There is a record of your arrest when you are arrested and this arrest can show up on a background check report right away. There will be a record of your arrest and the charges filed against you even if you have not been convicted.

Whether a prospective employer learns of your DUI arrest and conviction can depend on what sort of background check the employer does on prospective employees. Not all background checks are created equal.

Around here even normal traffic citations are public record. You get a ticket and you can coun't on a few postcards from attorneys offering their services.

In addition, a DUI can affect employment even if hired without a background check or if hired conditioned on a background check. Even if an employer does not learn of the DUI before hire, an employer will learn about the DUI soon enough.

The fact that you were arrested, charged and/or convicted of a DUI, in other words, is not exactly a secret.
