Question regarding the effect of previous convictions on pending charges

I don't think it will effect the charge. That was done when you drove intoxicated. It may affect your charge. However, you may be safe. First off, Missouri's prior offender law only looks back five years. Second, the prior offenses are defined three ways none would seem to apply to the California (wet) reckless. The persistant offender status goes back forever, but you need to have had two priors to trigger that. Of course, your history is availble to the judge so he may take that into account with whatever discretion he has in sentencing.

There is a 5 year look-back period in Mississippi on DUI offenses. If your previous conviction was nine years ago in California, it should not be a factor in your sentencing.

I think your previous (9 years ago) conviction is not going to impart any effect on your current conviction's sentencing. So, no need to worry about it. Just hire a lawyer, and focus on dismissing your current conviction. All the best

techsparrow was convicted of reckless driving 9 years ago in California but is CURRENTLY CHARGED with a DUI in Mississippi.

Convictions are not dismissed. Charges potentially could be. The chances of this happening are better with the help of an experienced attorney.
