while in elementary school my son had several run ins with a bully in which he was assaulted. The school through an investigation determined from witness statements and the statements of my son and the bully that, he did nothing to instigate nor perpetuate the situation. The bully just pushed and punched my son. There were 2 against my son substantiated and several against other students.
Fast forward and now we are in middle school. My son was attacked and punched in the head by the same bully today. He did not retaliate but reported to the teacher and promptly upon returning home filed a bullying report.
Based on Florida statute section 784.03 this child committed a simple battery against my son.
My question is this. Can a minor be arrested on a simple battery charge? I would like this child arrested and charged through the juvenile system. But I'm unsure if those Florida statutes apply to minors...any input from an attorney is appreciated
