Fair Use In Riset & PPC,PPD

Hi!,

I recently making articles about education. In these articles, contain random sources from other sites. My article according to our Copyrights Law is not break any rules. For example; write the references on below article, Give [1],[2] on top of sentences and connected to references below, didn't sell it and didn't inflict financial lost to copyrights holder.

My question is, When i put these article to Word/Pdf and Make it to Pay Per Click (PPC) and Pay Per Download (PPD) do these inflict financial lost to copyrights holder and infringing the copyright holder ?

my country's copyrights law is adobted from US Law it self. So there is slightly similarity to US Law.

You need to concern yourself with the laws in your country. If sued for copyright infringement, you will be sued by a copyright holder in your country's courts under your country's laws.

In the US, there is a "fair use" doctrine that can allow some uses of copyrighted works without permission from the copyright holder. Fair use includes the limited use of copyrighted material as part of scholarly works (education, research). Fair use is an affirmative defense to unauthorized use, however, and not permission to use the copyrighted material. It can be used to defeat an infringement claim.

Prior to making your articles available for download, and profiting from what you wrote, you should have your work personally reviewed by a publishing law professional in your area to see if your uses of the copyrighted works of others infringes on any rights.

Luckily my country also has similiar "fair use" called "Reasonable interests" but it rules are not comprehensive and detail as "fair use" in the US Law just 5 to 7 paragraph.

I think my country don't taking "Reasonable interests" very seriously because many of author same as me in my country also wrote many articles without looking at the rules it self. Yeah, my country jails can hold so many intellectual person if this "Reasonable interests" is taking too serious. Yeah, plagiarism everywhere.

I recommend, wherever in the world you happen to be, that you respect the original and creative rights of others and seek permission from the rights-holders prior to using their material. Acquiring permission first is the best way to avoid a lawsuit.
