What is the name of your state (only U.S. law)? PA

Hello,

I've been with charged with DUI in the State of PA. I also refused everything (FST, ROADSIDE BREATHALYZER, & "REAL BREATHALYZER"). I also have a NJ DWI, which I thought was a traffic citation. Am I eligible for PA ARD?

As stated, you need a lawyer. The refusal has sanctions of its own (a year suspension). FSTs and chemical tests are not absolutely necessary to convict you of DUI. In fact, you're probably screwed more with the refusal than if you blew. The NJ DUI wouldn't have counted as a prior and you could have gotten an ARD which would have avoided a conviction and only had a minimal suspension.

What you also need, is professional help for your substance abuse problem. You meet the clinical definition of a person with such a problem.

Thanks for replies. Have a lawyer and in regards to refusal... more complicated then just me saying "no", but thank you for the kind advice of seeking "treatment".

You have an attorney ....So why are you posting here? Ask him/her.
