Sorry nothing showed up. My neighbors hill behind my house has slid off and causing a mess. I'm afraid one more good rain and it will be in our house. Is he liable for fixing this

I doubt it.

Now that you know that rain causes dirt to flow on to your property, it's up to you to do something ON your property to prevent mud and dirt from getting into your house.

What is the name of your state, Moore2010?

Has there been any alterations in the landscaping of either your property or the property of your uphill neighbor, an alteration that perhaps diverted the natural flow of water?

If your neighbor has diverted the natural flow of water and this has led to water damage to your property, the uphill neighbor could be held responsible for the damage. If you altered your property, you would be responsible for any resulting damage.

Could you provide more details please, starting with the name of your state? Thanks.

I live in Virginia, and no altering of either property has taken place. It is all erosion and runoff.
You are responsible for handling the natural course of rain water that runs from the top of the hill to your property below.

Have you not had this problem before, or has it just gotten worse of late? You would probably be smart to have a landscape engineer/architect come to look at your property and the erosion of the hill. There are ways to combat erosion through plantings and retaining walls. Your uphill neighbor would benefit from a professional assessment of the problem, too, before all of his property becomes yours.
