my daughter wants her belly button pierced but her mother and i are going through a divorce. for the state of florida, does the fact that we are going through a divorce change anything? could i get in trouble for letting her get a piercing considering it is technically legal?

It would help if you could tell us your daughter's age.

MINORS.—A person may not perform body piercing on a minor without the written notarized consent of the minor’s parent or legal guardian, and an establishment may not perform body piercing on a minor under the age of 16 unless the minor is accompanied by a parent or legal guardian.

You wouldn't be doing anything illegal by allowing her to get a body piercing, but you may have to accompany her, depending on her age...and you will need to give written & notarized consent.
Whether or not it can cause trouble for your divorce is not a question any of us can answer.

If the divorce petition has already been filed and served I suggest you read it carefully, specifically the "preliminary injunction."

Preliminary injunctions granted during divorce cases prevent the spouses from engaging in activities that might harm the other person, legal rights, or property of the other spouse.

Allowing your daughter to get her belly button pierced over her mother's objections could fall under the preliminary injunction even if that particular activity is not specifically prohibited and could get you in trouble with the court.

I suggest you ask her mother and if her mother says no then you say no.

If her mother says yes, get it in writing.

I disagree with the notion that any automatic temporary injunction/restraining order would apply in this situation. I do, however, agree that it would be safest to avoid approving this during the divorce proceedings.

Let me try and put this into perspective: how will this make the divorce go more smoothly? Is there a reason t hat your daughter can't wait? I'm pretty sure that the belly button will still be there when the divorce is finalized. Just because it's legal doesn't mean that you should do it.

Mom might not be able to undo it, but she can certainly double down on any legal issue you are quibbling over, and you could be adding fuel to that fire. Mom can use it as an example of you not being willing to co-parent.

Would you allow this if you were NOT in the middle of a divorce? Are you doing this to piss your soon to be ex off? "Win" daughter to your "side"?
