My state is Georgia
6 months ago my family of 3 along with 3 horses and 1 dog moved into the rental
Our rental is situated on a very large piece of property owned by the LL. she had no probem with our dog Yeezhur roaming freely. The LL home is only about 75 ft from our rental
She showed immediate interest in our dog from day one. Constantly luring him into her home with food. But she constantly complained about him coming into her home. He came home 3 different times with collars I had not put on him. I removed each on. I asked her if she put them on him she said yes, because the only way she could get him out of her house was by dragging him out by the collar. She then demanded I stop removing the collars. I told her no. I told her to stop allowing him into her house and not to feed him anymore. She then got irrate and demanded we build him his own fenced in area. So we did. BUT she would come over and let him out to roam or put him in her house. Stating he shouldnt have to stay penned up when he had such a large area to roam. And she enjoyed his company. I stayed completly confused from her 6 month long irrational behavior, beratement, slander, harrassment and just plain rudeness towards me and my family it got so bad that I carried my phone with me at all times just in case I was confronted by her. That way I could record everything said. My phone is now full of videos and recordings of her harrasment.
Her first complaints and harassment started with my horses eating her goats food. She demanded I build the goat its own area to eat without interference from my horses. I did exactly that. However the complaints about my horses never stopped.
A bizarre complaint came on the day she knocked on my door with a handful if MY mail. She said i need to get my mail out of the box. I told her i was sorry and hopefully the mail carrier would stop putting MY mail into HER box. That was when she said NO your mail isn't in my box it is being put in your box but you are not checking it often enough. The handful of mail she had in her hand came out of my box. She was checking MY mail in MY box and taking it out!! She then demanded I check MY OWN mailbox everyday. Needless to say I was baffled.
She would corner me almost everyday with a new complaint while I was outside working with my horses or playing with my 3 year old daughter. It got so bad that I no longer wanted to leave my house to work with my horses or play with my daughter in the yard. I would keep the back door open and watch my daughter play outside while I sat inside the house hidden by the door.
Then she started cornering my husband immediatly after he drove up after work. She began accusing me of leaving our daughter in nothing but diapers outside unattended to play. My daughter was fully potty trained at the time and no longer wore diapers. And was never left unattended outside. So I stopped letting our daughter outside.
This was when I could tell depression was setting in and I was starting to lash out at my husband about the most simple things. We also started arguing alot. Which was something we rarely did before moving there. But if we ever did need to have words we would make sure our daughter was not in the same room.
I felt trapped in my own home. My husband started feeding the horses in the morning and evening because I no longer wanted to go outside at all in fear of any confrontations with her. My marriage started falling apart because I was so reclusive and 2 months ago I couldn't take anymore and decided to move out and seperate from my husband. So I found an apartment for my daughter and I and moved in. Leaving my husband to live in the rental with the horses and dog. Last month I sold my horses which sent me into an even deeper depression.
I got a call from my husband this monday. He said the LL was accusing me of stealing her daughters coffee table out if the shed behind the house while I was removing some of my property out of the rental house. She told him if I didnt return it she was going to call the police and have me arrested. I called her and asked what was going in. She told me i stole the table and if it wasnt returned I would be arrested. I told her no i did not remove it. And in fact the table was still exactly where it had always been in the shed. She basically called me a G#D damned liar and hung up on me.
By this time my husband left his job early just to go take pictures of the table in the shed for proof just in case she decided to remove it herself and blame it on me.
Tuesday I got another call frim my husband. He said the LL knocked on the door demanding to come in. He refused her entry. She then wanted him to sign ownership of Yeezhur over to her. He said absolutely no. And that I was coming the next day to pick him up to bring him to my new apartment.

Yesterday I called the LL grandson that lives with the LL to ask him if he knew where Yeezhur was because I was on my way to pick him up to take him to my new apartment.
The grandson stated he did just see him and would have him ready when I got there. When I arrived the LL, grandson and Yeezhur were no where to be found. I called the LL and asked her where Yeezhur was. She said she didnt know and hung up on me. Luckily I recorded this phone conversation. We spent the rest if the day and into the night searching for him.
Yesterday I called animal control. A deputy was dispatched to her home and she admitted to taking Yeezhur. He advised her to return him. I was supposed ti receive a call from the officer once she dropped Yeezhur off at the animal control office. I never received a call.
My 3 year old daughter is very distraught complaining of headaches ( something she's never done before) she has been very anxious quiet and crying for him since looking everywhere for him lastlasnight.
I want to know if there is a case to sue the LL for the distress she had caused my daughter from this episode and from the 6 month long history of harrasment we have received from her. She has caused such turmoil in my life. Basically ruined my marriage. Made me lose my horses which have been my life long passion. And now my daughter has lost her dog to this monster.

Thank you Quincy. Learning to maneuver the site with my phone has proven to be quiet a challenge. But I think Im getting the hang if it now. I felt my post needed to contain more descriptive information to get the proper advice. So I deleted my very first tries at posting my thread and replaced it with my edited rewritten thread. I also shared it on other boards to get a broader audience in hopes I can find someone that may have the advice I came here searching for.
And yes I hope adjusterjack comes back he was very helpful and i want him to read my rewritten thread because he had a few questions and needed more infirmation about my issue. So hopefully this longer version will contain what he needs to give some helpful advice.

I suggest you concentrate on getting the dog back. You mentioned earlier that you called the police and animal control but you haven't said anything further about the police. The police may be able to put more pressure on the LL (threat of arrest) to retrieve the dog.

It's unfortunate that all this has happened to you but, no, I don't see you being successful in a lawsuit for emotional distress. Sorry.

Unless the lease gave you written permission to have every single one of those animals, you have nothing.

My rental agreement was written up by my LL and her lawyer. They put special clauses in it for the 3 horses a dog.

Update on yeezhur

He has been returned to the Humane Enforcement Dept. safe and sound!! I am on my way to get our boy right now! I am so excited! I can't wait to bring him home and surprise my daughter! Thanks to the ones that showed support!!
