What is the name of your state (only U.S. law)? Florida
I live in the state of Florida and purchased a house 50 years ago with a mortgage from the seller. Everything was done with a lawyer. We have the deed for the property. To make a long story short the seller has died. Many years ago I hired a lawyer. The seller lived in Michigan and the house was never mentioned in the estate. Nothing else was done. Previously I had talked to sellers attorney in Michigan to try and get a satisfaction of mortgage and lawyer insisted we did not need a satisfaction of mortgage because we have the deed. I have every cancelled check for the mortgage payments.
We are now thinking of selling our house and I am wondering if I can get title insurance without a mortgage satisfaction. If I cannot, what do I have to do to be able to sell the house. There are no liens against the house.
