What is the name of your state (only U.S. law)? Illinois (Kendall County)

Received a citation to discover assets in the mail today from a Judgement Dated September 2014. The court date is July 19th.

I actually ended up paying this off in total before that date (an obviously before I received this citation) on the 21st of June. I see they went to court and filed this on the 20th, so it makes sense why I got this in the mail.

How is this going to work? Do I still have to go to court? Or since it is paid off in full is it just a non-issue? If I don't go will there be a warrant for my arrest (even though the debt is paid in full?)

Thank you for all of you help/suggestions in advance!

The plaintiff should file a Satisfaction of Judgment form. See here for more info: https://www.illinoislegalaid.org/legal-information/getting-release-and-satisfaction-judgment

Thank you so much for the quick reply! How long do they have to do that? Do I still have to show up in court? Should I call my bank and make sure they cashed the certified check? I am sorry for all of the questions and thank you again for taking the time to reply to me! :)

Start with asking when they will file it...it should be done before the 17th...

Perfect! Thank you so much for all of your help and answers, I will give them a call on Monday and see how fast they can file (I had to send the check to MInnesota so I understand there being a little bit of a delay.)

Thank you again!

Make sure you verify that the satisfaction of judgment is filed with the court by checking with the court to make sure and getting an order cancelling the court date. Don't rely on anything anybody "tells" you. See it on paper with a judge's or court clerk's signature. Otherwise go to court on the appointed date with all your evidence of payment and have the satisfaction of judgment done then.

This might sound like a dumb question, but how does one check with the court, and how do I get an order to cancel the court date? Do I go to the clerk? Or is there some other body that I need to contact.

Thank you for the reply!

See if your court has an online docket. The online docket will often provide the title of a document and the date filed.

If it doesn't have an online docket you can call the court clerk, give the case number and find out over the phone. But if you don't receive the paperwork in the mail prior to the court date, then go to court.

An update:

I received a letter from the law firm where I sent the payment stating that they have received my payment and their file is now closed. However I went online to my county court house docket and the date (7/19) is still listed as the "next date" for this case.

Is there something I have to do to get this date removed? I called the law firm where I paid and they said they "started the process" but don't know how long it will take. Thanks again for all of your help everyone!

Also, one more question upon further inspection: What I received in the mail, first class, is a copy of a 3rd party citation to discover assets sent to my bank. My name only appears as a debtor...I was never served with anything. Is it possible this is just a 3rd party thing and not really intended for me other than to let me know that they have served a bank I used to use?
