Hi, I am really in need of some advice. My children have been attending a private catholic elementary school for 5 years. My second grader class only has 3 other boys (8 girls) and we were thinking if pulling him last year because of low ratio, as well as two of the boys fight constantly, and the third boy is the principals son.
So here's the problem now. Mid may the principal was fired but remained at the school until the last day June 7th and the school kept this information from parents until the last day. The deadline for withdrawal from school contract was June 1st. So now my second grader is left with just 2 boys that fight in his class since the principal has left along with his son. We spoke with the school and they agreed to let us out if the contract for my son.
As many parents know this is a difficult time to now try to find a new school on short notice. With this said, we will now have problems with my 5th grader, in terms of transportation between the two schools and we have found this really isnt an option as both myself and wife work full time. We have started the process to remove my daughter from the school as well but we are meeting resistance.
So here's my question. Do we have legal grounds to fight the tuition contract for my fifth grader on the basis that the school knowingly withheld the removal of the principal until after the withdrawal deadline? Wasn't it there obligation to notify the parents immediately? In my case the school circumstances changed drastically for my son in which we needed to pull him, while as a family unit we cannot have the two at different schools. Any help or advice would be greatly appreciated.

Thank you in advance.

So what is it that you're complaining about...the principal leaving, or the ratio of boys to girls, or the fact that a couple of the kids don't get along?

No, you have no legal grounds. Negotiate.

Why do you believe you had a right to know about personnel issues at a private school? What law do you believe gives you that right? Does your contract state that you can remove your children if the staff changes?

For my second grader they let us out of the contract, it's now my for fifth grader we need to get out due to transportation issues, it is out of our capabilities to transport to 2 different schools. Had we known, The principal/son was leaving which the school failed to disclose prior to withdrawal date the circumstances changed in which they were obligated to tell us. But didn't we would have left prior to the withdrawal date.

Since they cannot force your child to attend their school, what are the contractual damages for breaching the contract?

They aren't obligated to tell you about personnel changes.
The fact that you don't have adequate transportation isn't grounds either.

Depending on the specifics, they not only had no obligation to tell you about the personnel changes, but they may have been prohibited from doing so.

I know they were not prohibited as the principal himself told us at a play date it was his decision to withhold the information. Thank you all for your feedback.

There is a difference between the principal himself telling you, and someone else telling you.
