What is the name of your state (only U.S. law)? Colorado

How is it possible for a trademarked slogan to be live if a company has not filed their maintenance documents? This was taken from TESS:


Required maintenance filing has not been submitted,
or the timely submission has not yet been coded as a maintenance filing.
If the required filing was not submitted on or before Jul. 24, 2015,
the registration will be cancelled in due course.

If the company does not file maintenance, will the trademark eventually die? Or would someone be able to scoop up the trademark?

In the US, it is the use of a trademark (name, logo, slogan, colors, smells ...) in commerce that confers rights. Registration is not necessary.

In the US, it will be the first to use a mark as an identifier for goods/services who will be the presumed owner of the mark. This, however, is a rebuttable presumption.
