Need help with lying attorney for a creditor of mine

Louisiana is where I live.

I have no record of the payments I have made towards a debt owed, which I paid directly to the attorney. His office should have a record of all my payments. However, he lied in the latest legal document he sent me, saying the burden of proof is on me. He knows that I lost my home and all documents in it, in a flood in 2016 and that I would have difficulties proving my payments. I could ask the bank to research this and pay them lots of money to do so, but the attorney only gave me 14 days to prove my payments were made. The mailing didn't even reach me until 11 days, and I still don't know what to do or if I even have time to do anything. Also, he says if I don't prove these payments were made, I have to pay the full amount on such and such date. I don't even have a job! Also, when I don't pay the full amount, since I have no job, what can he do to me, or what can the court do to me? Please advise.

Curious..How much is the attorney asking and how much would it cost you to prove what you paid?:confused:

I know they would have to research over a year ago to see how many times I paid the amount of the installments. I would assume each one they found would be $20 or more. I'm not sure though. The attorney wants the full amount which is between $1600 and $2000. I don't have the paperwork in front of me for the exact amount.

So...You should do a cost analysis of the situation.

I know, but I feel like there just isn't time. So, I guess I'm mainly worried about what the attorney and court can do to me when I don't pay, since I'm not working.

Do you live in a cardboard box under the bridge? You "seem" to have a home...So how do your bills get paid? :confused:

BTW: If I am coming across as snarky...I don't mean to. Just trying to get a idea of the situation.

You don't need to know how I survive. All you need to know is that I don't work. Therefore I shouldn't be expected to have money to pay this attorney.

Unless of course the OP is on SSDI or SSI because he/she is disabled.
If that were the case, the OP could have (and would have) said so, as opposed to giving a flippant and rude reply. The OP wants advice, but declines to given relevant information.

When the attorney sues you for the amount outstanding on the debt, you will need to answer the complaint and appear in court with whatever evidence you can scrounge up that supports your story that you paid as agreed.

When the court finds for the attorney, there will be a judgment against you that is collectible for years. Any income or assets you acquire in the future will be vulnerable until the judgment is satisfied.

No one can pay on a debt if they have no money to pay ... but the only way for the debt to go away is to pay or to file for bankruptcy. There are cons to filing for bankruptcy, especially over a $2000 debt. Discuss the pros and cons with a professional in your area, perhaps one at a free legal aid clinic in your state.

Being rude to the volunteers on this site is not a good way to get advice. I think you owe an apology to Blue Meanie. Your rudeness to her was unwarranted.
