Good morning,
We just found out today that my husband has a warrant in Kentucky from 2005 (we are in Ohio). We have had several background checks this year, and the warrant and charges never popped up, I'm guessing because they were in a different case/county. The charge was a misdemeanor charge for possession of marijuana and underage alcohol possession. We called and talked to the clerk, and they said that he can come down next week and go in front of a judge.

I am guessing that it will get continued, right? What kind of evidence will he need to present? What kind of evidence might the county still have?

I know that marijuana laws in Kentucky have changed a lot since 2005 and now - if he is found guilty, will he be sentenced based under the old laws or the new laws? We really have no idea as to what might happen.

If you could provide any insight, I would appreciate it!!

Your husband should have an attorney with him when he goes to court to turn himself in on the warrant. He could be jailed on the warrant while awaiting sentencing on the misdemeanor marijuana and alcohol charges. Be prepared to pay bail.
