Cleveland oh, my land lord came to my house 9am without notice, I did not answer , later that day I was on the porch and she pulls up to my house and tell me come here , I get to her car and tell her someone broke in both my cars , and it looks like they tried to break in house the screen door is messed up, she says to me she doesn't think someone would try and break In a down stairs unit of a 2 family house , I have to fix the door because it's my house , I said to her you own the house it's not my fault you lied to me and said it was a great neighborhood and someone tried to break in , I said to her I will fix the door anything else , she says to me she has plenty of people who will move in and shows me a paper of all the houses she has , i said okay and walked away she gets out her car and asks my wife for the keys to the house my wife refuses she stands in the street and says where ghetto and calls a friend of hers who pulls up to my house , I leave go to store come back home to a 30 day notice ,I agreed with her a year ago to do a month to month lease because I needed a bigger house , I feel I can sue her for emotional distress and harassment and defamation of character, she broke our verbal agreement I never asked to move , someone help me out and tell me what way to go , I can't find somewhere to live in 30 days ,

Your posting is a bit confusing to read but the bottom line is that you have a month to month tenancy; such a tenancy can be terminated with a notice provided at least 30 days prior to the next rental period.

This appears to have been done. This means you must vacate the rental unit as of the end of September. Here is the statute for your state:

It's unlikely you can sue her for harassment, emotional distress and defamation of character. It would be better if you spent the time looking for another place to rent in the next month.

What's confusing,? She basically kicking me out over someone trying to break in my house and me asking her to fix the door , She knows we agreed to a month to month because i needed a bigger house . So her giving me a 30 day notice stressed me out I'm not ready to move yet I have to find my kids another school now and it just started , She put slot of stress on me and my wife and I will see her in court because I feel she is wrong , and I gave her on video calling me ghetto in the middle of the street saying give her the keys , I don't see how that's not emotional distress are Harrasment , She played me . I got the notice July 1st when do I have to be out ?? Can I use my security deposit to stay another month ?

You were given notice on the 1st of July so you had till Aug 1st. Security deposits are for any damages that may have been done to the apt...not for rent. Just find another apt in the same school district.

In a month to month tenancy you can be given a 30 day notice any time for no specific reason. If you do not want that, sign a long term contract.

Take pictures of the things that looked like they had some wear and tear going back to when you moved in and plan on taking pictures to show how nice and clean you left the apartment. Just so you know , there is no way to predict when knuckleheads will start breaking into homes in areas , some friends of mine in the Dayton- Riverside area tell me in less than 2 yrs the area they live in has had a nasty theft problem grow. Trouble makers come and go. BUT no matter what a landlord tells a tenant about a neighbor hood , they can change as easily as the seasons.

You are asking questions on a legal forum. You were provided the statute for your state regarding termination of a month to month tenancy.

You may be stressing out over this but you'll likely stress further if the landlord files for an actual eviction if you failed to vacate the rental unit within the required time period.

When is your rent due? If the first of each month you have, at best, until the end of August to vacate this rental unit. If you fail to do this the landlord may now file for an actual eviction based on the fact you are a "hold over tenant". You don't want an eviction on your credit record as this will make it more difficult for you to find suitable housing in the future.

Can you sue her for calling you "ghetto"? Sure. Will you win some kind of money because of this? Highly doubtful; what you were called plays no role in your landlord terminating your month to month tenancy.

It would be a very good idea with your next rental property to request a year lease instead of a monthly tenancy.

Gail,

OP stated that s/he received a 30 day notice to vacate on the 1st of July. Doesn't that mean a move out date of the 31 of July (30 days later)?

Perhaps their rent payment date is different than the first of the month? Or perhaps the landlord is "covering all bases" (so to speak) by preventing a claim that they did not receive this within the 30 day time period prior to the next rental period.

Or maybe they got their dates wrong and got the notice August 1, not July 1? That was my first thought because who would wait almost two months before seeking online legal advice?

Yea I got the notice on August 1st my mistake and thanks for the help , I know she will try to keep my deposit because of door ,, So I'll end suing her anyways , I thought her just coming to my house without permission was harassment, 2 times in 1 day , She has my number , And she called her cousin to my house , For what ? To fight, Told me she NEVER loses a case lol , So I could be scared to take her to court ,
