In Arizona school is only compulsory until age 16. My stepson does not attend school with any regularity, he will not graduate as he is failing classes, he sleeps all day, smokes weed, leaves without telling us when to expect him to return, etc. But of course my wife and I cannot kick a 17 year old out of the house because he is a minor. Do we have any recourse at all? It seems like the law should line up so that any minor must attend school or that anyone not attending school should be able to be given the boot.

You might consider talking to the school to see if they have any advice.

You do have some recourse. You can make sure that he has no access to a phone, internet, or digital media of any kind. You provide nothing more for him than food, shelter and necessities. He cannot smoke weed if he has no access to money.

You can call the police when he is smoking marijuana or refusing to go to school as directed by you the parent. He could be judged an incorrigible child under ARS 8-201.

That said, I am not sure you or your husband want the state to step in. But it is an option.
