First of all I'm glad I found this yet, but my Mother and I need advice involving my Father. My Dad was sentenced to three months in Jail in Delaware for DUI and was due to come out October 28th, and my Mother called maybe days before just to make sure and we were told he's going to be held after the 30th because something came up involving another state and that is PA. Now Delaware really hasn't given any knowledge or news on where he's going to be sent to, or the Jail, but I'm like my Dad hasn't been in PA in many months, and it's already been three days and I'm starting to think they are not going to pick him up. I went on vinelink and saw their are quite a few guys who have my Dad's name and it wouldn't shock me to see PA get my Dad and another person mixed up. I researched a little and saw what a State can hold an inmate for another state for 30 days, and it's already been three days and it seems PA considers me Dad low on the Totem Pole because you would think they would of been ready to pick him up by the 30th. What should we do, if he does get sent to PA I see him seeing a Judge and bail being set and Court happening as per usual. It took 4 months for Delaware to sentence my Dad to 3 months and and I feel we could have a similar situation where he's home with us and 5 or 6 months later they sentence him to a few more months. What should we do at this point, because right now were living in a Motel and we can barely survive as it is, and this situation is ****ing us over. Advice surely needed if anyone see's this thanks.

How old are you? Why are you and your mother living in a hotel? Does your mother work?

You are correct that your father can be held for 30 days in Delaware while awaiting extradition to Pennsylvania to face additional charges there.

If you want to know what is happening with your father, the best way is to ask your father what is happening.

Your father has an attorney representing him, correct? If not, he should have one.

Pretty simple to understand were homeless and yeah I have a job that is keeping us afloat and my Mother has Diabetes and is not able to work and is still fighting Disability. The Attorney if my Dad has one hasn't contacted us at all.

We got word today he saw a judge and was denied bail, maybe that was due to maybe they are thinking he lives in DE, if we let him bail out he might not come back to PA for Court?

If your father has an attorney, his attorney will not be contacting you - at least without consent from your dad. The attorney represents your father and has a duty to protect all communications he has with your dad. In other words, you will need to speak to your father directly to find out what is happening with his DUI in Delaware and the charge(s) in Pennsylvania.

Whatever is happening with your father, you should probably not count on him helping you and your mom. He apparently is having trouble even helping himself.

No, your father is ****ing you over by being in trouble with the legal system.

You'll either have to wait and see what happens or go visit your father and find out from him what's happening.

Yeah we didn't have the best thing going with each other before going to Jail. My Mother and I found out he was having an Affair and when it comes to me, he owed me money via work which is why I stopped working with him for months till I got my own job in the same field. So I doubt he's going to Mail us or talk to us, but my Mom did sent a Letter to him today so who knows. Now here's an update it's been 6 days and PA hasn't come to pick up my Dad to see what's going on with those charges, but today we found out he has charges in New Jersey. In PA he has fines to pay involving Home Improvement and it was pretty much that he wasn't paying because he was Jail at that time and they wondered why he hadn't made a payment so that will work out itself when and if they pick him up. They have till the 26th of November to do so and my heart tells me they won't pick him up, but the NJ charge that the person we talked to, who never gave us the info on what the charge was, he could be not serving time with that all due to it being a first offense so that's good news to hear. Here's the kicker Delaware like a few weeks into my Dad's sentence there, had a second DUI charge that he had to play a fine for, or more so finish up paying for. We talked to the people in charge and they said okay he's in Jail for 3 months, just went he comes out, tell him to come to us and we'll get him back on a payment plan. Now I check Vinelink which is outdated as **** right now with it saying my Dad is Custody in Delaware, which is bs because he's in NJ waiting till tomorrow to see a judge that couldn't see him today. It shows up the second DUI charge hearing being on December 1st at 10 AM in the morning. I'm like what the ****, we told you he is having problems with two other states and you want to issue that, when if he has to serve any time in PA or NJ they'll have to wait longer for it and it's only 300 bucks left to pay. Yeah a day in the life of my family guys.:D

It is sad that your father is such a screw-up.

Yeah thanks some can say the Apple doesn't fall far form the Tree. My Dad's Dad serve time for rape of a young girl and he was in and out of Jail before that, which is why he was raised by people not his Parents for a good amount of his life before meeting my Mom at the age of 16. I just hope when all this is finished he see's the light and see after the possibility he's going to miss my younger brother's last year in High School that it's time to fix my life. A few years ago when he served two weeks in PA for Home Improvement he came home and gave off the vibe he didn't care. He said to the effect oh it's was a vacation for me, and I didn't have to stress about your Mother or your kids for a few weeks. Their was another time he and I got into a verbal argument through the Drive Thru of Arby's because he was going out every night, Drinking and Driving and I was telling Dad you're going to caught one day and serve time and it's not going to be two weeks, it's going to catch up on you. He says oh don't worry about me sighs.

You can't "fix" your father. He will need to find a way to fix himself.

I hope you and your brother find support from a counselor or friends.

New Update we were told this morning that NJ pretty much dropped his charge there I guess it's a small fine, that he'll never pay for because he doesn't live in NJ and it's a long ass drive to make a payment and he could forget all about. Also they told us he was in PA, but I'm getting right now he's under Community Supervision? Now I do know about people in Delaware where they go with this program my Dad's Brother was at this same place for like 6 or 7 months, but I have no clue what is the goal of such a program. Right now I'm hoping they let him work back with his boss in PA, and in a few months he can transition to coming back into the real world.

Also they told us he was in PA, but I'm getting right now he's under Community Supervision? Now I do know about people in Delaware where they go with this program my Dad's Brother was at this same place for like 6 or 7 months, but I have no clue what is the goal of such a program. Right now I'm hoping they let him work back with his boss in PA, and in a few months he can transition to coming back into the real world.
If he doesn't pay the fine, he will have a warrant out for his arrest and can rot in jail.

"Pretty much dropped his charge" has no meaning. Either it was or it wasn't and it sounds like you have no clue about what's happening. What is your source of information?

Courts do no impose fines and then tell defendant to "forget about it". That's ridiculous. It sounds as if your father is setting himself up to get into yet MORE trouble with the law.

He doesn't have to make a "long ass" drive to make a payment. There is such a thing as the US Postal Service.

Although this man is your father and I can understand your interest in what is happening to him from that perspective, you might be better off concentrating on things other than your dad's criminal woes. Let him deal with his problems by himself.
