To be more clear, we were the homeowners. The house was foreclosed on in August. We were offered cash for keys, though it was not titled as such on the paperwork we were given. It was just titled "relocation assistance". The term cash for keys was also used verbally.

"Cash for keys" is slang. It IS relocation assistance. I concur that you should have taken the offer and left.


ETA: They made a non-negotiable offer and you indicated a desire to negotiate, so they withdrew their offer.

THe cash for keys and the door notice are not mutually exclusive ...nor is it clear that offer has been withdrawn ...

OP might be smart to accept the offer with no debates on details..and do so exactly as set forth in offer and if not...in writing and see letterbox rule ? E.g. Lock 🔐 n acceptance before its withdrawn .

OP it seems you hold almost no leverage ..and I'd not ask questions at this point . .

Kevin at any time since the property changed ownership did they ever give you a written notice that would give the same number of days to move out that would have been given by a new owner (aka landlord ) to someone with out a written agreement for multiple months to move out ? ( state by state the number of days of notice is different ) like in my state for example a tenant does include non paying occupants SO to give a proper notice to someone to get out in my state the notice has to be sent out for a whole rental period like if I wanted someone gone now I would have to send them a notice that arrives on or before 11-30 -2017 to be out by 12-31-2017

They aren't tenants.

They have lived in a home that has a new owner and if the new owner did not give them proper notice to get out after almost 2 months of continuing to stay on how is it that they are not entitled to proper notice to vacate ? The OP may have been trying to negotiate a financial incentive for leaving with the buyer which the buyer does not have to agree to but how is Kevins staying on - residing there any different than a someone who stays in a home that a relative or friend owns and is not paying rent for what ever reason any different than that , we have seen plenty of postings where we have told owners who had unpaid / with out compensation family members /friends living in properties they owned and they were all told to give proper notice since landlord tenant laws still applied so Kevin I suggest to you that you search with in your states laws to learn if they have exemptions for how much notice you should have to get out because the home was foreclosed. this new property owner should have issued proper notice to vacate since the home was not empty with in a few days of buying

There is a 30 day period after foreclosure the buyer can’t make the prior owner move. It’s a redemption period and until that time expires the foreclosure isn’t complete. It does not establish a tenancy. After that the owner can seek an eviction after a 3 day notice.

I understand your argument. If there was any negotion to leave I think your argument fails as it shows there was no intent to establish a tenancy. If the buyer simply ignored the situation and allowed the prior owner to remain for some period of time beyond the 30 days with no attempt to seek their removal, then I think you might have an arguable point they require a 30 day notice.
