hello I have received 3 false copyright strikes on YouTube.one video is a 16 second video I took of a goat on a farm? I first replied back to the person who is using a fake name and he said in the email he would shut my channel down. I have contacted youtube by phone , multiple emails but just get mainly auto responses back. The issue is all 3 strikes are from 3 different fake names and this user has been know to release personal info. If I file a counter complaint I have to release all my personal info for him to have and do as he pleases with.i have called 40 plus lawyers but can not find any help. I am at a loss on what to do any help would be appreciated
Are you in the U.S.?
When someone submits a DMCA notice to a website, the website must remove the allegedly infringing material or risk losing their immunity from suit. You MUST file a counter complaint in answer to the takedown notice if you want your non-infringing material returned to its place online.
Yes, this means you will have to disclose your identity. This is so the one claiming infringement can file a copyright infringement claim against you, which is the only counter a copyright holder has to a counternotice.
If you believe your videos are being targeted unfairly, have you thought to change your YouTube account information, posting your videos under another name?
One additional note: As someone whose material was removed because of a FALSE takedown notice, you could be eligible for damages and attorney fees if you can prove that the one claiming infringement did so knowing the claim was false.
