My case is very similar to one being discussed in this forum. I purchased a new car from a Honda dealership and I apparently qualified for a new grad discount even though I don't finish my final course until the end of Fall. It gets the dealer $500 which they in turn applied towards my down payment. They did not list it under "rebate" on the Retail Installment Sales Contract. Instead they listed it under "other".
When I bought the car they had me fill out two contract. One with the $500 credit and one without. They said the only thing I needed to do was bring in my official college transcripts within 7 days or I would not get the discount. I brought them the transcripts 4 days later and they poured over them for about an hour then sent me to finance to sign the sales contract which includes the $500 discount. Both the dealer and I signed the contract and he verbally said if Honda doesn't pay us you may need to pay us back the $500.
Two weeks later they called me and told me that Honda Corporate did not accept the transcripts I provided and that they are nullifying the sales contract I have and I need to come in and sign a new one that does not include the $500 discount. I have already put $3,000 down and I already have financing through a credit union that I am planning to complete this coming week. The Honda dealer told me they will repossess the car if I don't come in and sign the new contract by July 31.
I told them that they signed an arbitration agreement along with me for any disputes related to the sales contract etc. They told me that does not apply and the contract is not valid.
I am not planning to bring the car back to them or sign a new contract. I want them to take me to court (small claims or the arbitration-which they have to pay for). When we originally made the deal there was no mention of if Honda does not accept my transcript, only that I need to bring them transcripts which they actually looked over then sent me home with a signed contract. I believe it's their fault for sending me home that day with the discount after having a chance to go over my provided documents.
